CASE

PUBLIC HEARING: CONSIDER ADOPTION OF ORDINANCE
REGULATING THE POSSESSION, SALE AND CONSUMPTION OF INTOXICATING
AND 3.2 PERCENT MALT LIQUOR
By: Jim Way, Police Chief
William K. Goodrich, City Attorney

Background:

During the March 23, 2004 meeting, City Council and staff reviexved the proposed ordinance
amending sections 7.51, 52 and 53 of the Ramsey City Code which deal with intoxicating liquor
and 3.2 malt liquor regulations. Staff had determined that combining these sections into one
ordinance will make it easier to read and understand. The ordinance presented is modeled after a
League of Cities ordinance to accomplish this same purpose. The ordinance incorporates by
reference all current State Statutes regarding intoxicating and malt liquor sales. Staff also
included the directions given at the Council's March 1, 2004 work session, which primarily
relate to the 2:00 a.m. closing option. Chief Way had determined that an additional fee of
$300/year is an appropriate amount to charge licensees who choose the 2:00 a.m. option. The
City Council introduced this ordinance at their March 23, 2004 meeting. The typographical
crrors noted at the March 23 meeting have been corrected. Council is asked to conduct a public
hearing at tonight's meeting, and to consider adopting the proposed ordinance amending the
liquor section of the City's Code.

Council Action:

Motion to adopt Ordinance #04-XX regulating the possession, sale and consumption of
intoxicating and 3.2 percent malt liquor.

Reviewed by:

Police Chief
City Attorney
City Administrator
City Clerk

CC: 04/13/04
