SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />17. Requirements for Building and Occupancy Permits. No building permit for any lot in the <br /> Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br /> structure; (b) a Certificate of Survey, including that survey information required by the <br /> CITY has been supplied to the City Building Official; and (c) all the financial guarantees <br /> required by the CITY have been satisfied. All foundation approvals will require a certificate <br /> of elevation verifying that the actual elevation is in compliance with the approved grading <br /> and drainage plan. (d) this Development Agreement has been signed and received by the <br /> CITY. <br /> <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) all <br />utilities are in place, operational and accepted by the CITY; (cJ for lots that have a slope of <br />less than 2%, a certificate of grading, prepared by a licensed (State of Minnesota), <br />professional land surveyor, must be provided to the City documenting that the flattest grade <br />on this lot is 1% or greater will require certificates of grading; and (d) boulevard sod and <br />landscape tree, or escrow for same, have been provided. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />18. Land and Cash Contribution. The Plat is located in the Sunfish Lake Recreation District. <br /> Park dedication requirements shall be satisfied by a cash payment for the second phase. The <br /> park dedication for the first phase consisted of .5 acre land dedication and a case payment of <br /> $62,676.00. The second phase of Alpine Acres Plat is platting 48 units, which equates to a <br /> cash payment of One Hundred Five Thousand Six Hundred Dollars and no Cents ($105,600) <br /> due to satisfy park dedication requirements for second phse of the Plat. This payment shall <br /> be made to the City prior to the release of the Final Plat for recording. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />19. Trail Development And Fees. The City Council has enacted a trail development fee in the <br /> amount of Five Hundred Fifty Dollars and no cents ($550.00) per unit. As part of the <br /> Development Agreement for the first phase of the Plat, a credit in the amount of $7,775.00 is <br /> to be applied toward the trail fees in the second phase of Alpine Acres. Therefore, a payment <br /> in the amount of Eighteen Thousand Six Hundred Twenty Five and no cents(Si 8,625.00) (48 <br /> lots x $550/lot minus $7,775.00) shall be paid to the CITY prior to releasing the Plat for <br /> recording. <br /> <br />Alpine Acres Subdivision <br />Development Agreement <br />Page 7 of 12 <br /> <br /> <br />
