PROPOSED REVISIONS TO THE MIXED USE - PLANNED UNIT DEVELOPMENT
ORDINANCE ESTABLISHED IN CITY CODE:
· By: Megan Wald, Associate Planner

Background:

During the rewrite of Chapter 9 in 2003, staff brought forward a Mixed-Use Planned Unit
Development (MU-PUD) ordinance that would establish the opportunity for certain parcels to be
developed with a mixture of residential and commercial uses. The intent of the ordinance was to
allow flexibility in the appropriate amount of commercial and residential development, but in no
case shall a property be allowed to maximize development with a single use (i.e. residential or
commercial). To support the idea to capitalize on these unique opportunities the first statement of
intent statement of the MU-PUD district states that this district "is to provide a range of retail
and service commercial, office, and residential uses that are organized and planned in a
comprehensive manner."

Enclosed for your review:

1. Ordinance

Observations:

It came to staff's attention during the review of the preliminary plat for Rivenwick 4th addition,
that the MU-PUD district requires a minimum of 70% residential uses within a development. As
previously stated it was the intention of the MU-PUD district to capitalize on properties that
could provide a complimentary mixture of commercial and residential uses. The proposed 70%
minimum residential requirement appears to be contradictory to the opening sentence of the MU-
PUD intent statement.

Staff is proposing to delete the 70% minimum residential requirement and replace it with the
following statement; "to provide for an adequate mixture of commercial and residential uses and
in no case shall a development contain 100% of any one use." This would provide adequate
flexibility to achieve both residential and commercial development and notify developers that the
City will not accept a development plan that includes all residential or all commercial.

The Planning Commission held a public hearing and reviewed the proposed amendment at their
April 1, 2004 meeting.

Recommendation:

Staff and the Planning Commission are recommending the City Council introduce and adopt the
MU-PUD ordinance with the language change.

Council Action:

Motion to introduce Ordinance #04 amending the MU-PUD district.

CC: 4.13.04
