EXHIBIT A RIVER'S BEND 3RD ADDITION SPECIAL ASSESSMENT AGREEMENT THIS AGRI~.F. MENT made this day of , 199 3, by and between the City of Ra_rnsey, a Minnesota municipal corporation (hereinafter referred to as the "City"), and WITNESSETH: WHEREAS, (hereinafter referred to as "Owner") is the owner of certain real property in the City of Rarnsey, legally described as follows: Lots 1 through 17, Block 1; Outlots A, B, C, D, E, F, and G; River's Bend 3rd Addition, Anoka County, Minnesota (hereinafter referred to as the "Subject Property"); and WHEREAS, the Owner desires to subdivide and develop the Subject Property; and WHEREAS, the development of the Subject Property will require the construction of certain public improvements, generally including sanitary sewer, storm drainage facilities, water mains and appurtenances, streets with concrete curb and gutter, and street lights (hereinafter referred to as the "Improvement Project"); and WHEREAS, a public hearing on the Improvement Project was duly held on May 1 i, 1993; and WHEREAS, the Owner wishes for the City to consnmct the Improvement Project without notice of hearing or hearing on the special assessments levied to finance the Improvement Project, and to levy 100% of the cost of the Improvement Project against the Subject Property; and WI-I~E~S, the City is willing to construct the Improvement Project as requested by the Owner without such notice or hearing, provided the assurances and covenants hereinafter stated are made by Owner to ensure that the City will have valid and collectable special assessments to finance the cost of the Improvement Project; and WHEREAS, were it not for the assurances and covenants hereinafter provided, the City would not consu'uct the Improvement Project without such notices and hearings and is doing so solely at the behest, and for the benefit, of the Owner, NOW, THEREFORE, ON THE BASIS OF THE PREMISES AND TI-ZE MUTUAL COVENANTS AND AGREE/vI~NTS HEREI2~AFrER PROVIDED, THE PARTIES HERETO AGREE AS FOtJ DWS: 1. Owner hereby petitions the City for consmacrion of the Improvement Project on the Subject Property.
