THIRD A}fENDED <br />PERFORMANCE CONTRACT WITIt <br />~IE CITY OF RA~ISEY <br /> <br /> THIS AGREEmeNT, made and entered into thi~ 27th dmy of April, 1982 by and <br />between the City of Ramsey, located in Anoka County, State of ~finnesota, hereinafter <br />referred to as the "City", and Bartbel }~omes, Inc., baying its principal place of <br />business at 21370 John Milles~ Drive, Roger~, Minnesota 5537~, hereinafter referred <br />to as the "Developer". <br /> <br /> I. <br /> <br /> WHEREAS, the parties hereto have previously entered into ~ Performance Contract <br />relating to the development of the plat known as "Barthel~s Rum River Acres 2nd <br />Addition", said Contract being dated October 12, 1979, and <br /> <br /> II. <br /> <br /> WHEREAS, the parties hereto have amended the said Performance Contra&t by an <br />Amended Performance Contract dated October 8, 1980, and <br /> <br /> III. <br /> <br /> WHEREAS, the parties hereto have amended the said Performance Contract by an <br />Amended Performance Contract dated October 13, 1981, and <br /> <br /> IV. <br /> <br /> W}IEREAS, the Developer has now applied to the City to extend for two (2) years <br />the completion date of the blacktop improvements for Phase I as described in <br />Paragraph 1) of the Amended Performance Contract dated October 13, 1981, and <br /> <br /> WHEREAS, the Developer has now applied to the City to extend ~nttl October 15, <br />1984, the completion date of the blacktop improvements for Phase II as described in <br />Paragraph 2) of the October 13, I981 Contract, and <br /> <br /> <br />
