a) 162nd Lane N.W. from the West line of the plat to ita intersection <br /> with Germanium Street N.W. <br /> <br /> b) 164th Avenue N.W. from the West line of the plat to its intersection <br /> with Dysprosium Street N.W. <br /> <br /> c) Junkite Street N.W. from the North Boundary of Barthel's Rum River <br /> Acres 2nd Addition to its intersection with 164th Avenue N.W. <br /> d) Germanium Street N.W. from its intersection with the North line of <br /> the plat South to the South line of the plat. <br /> <br /> e) 161st Lane N.W. from Germanium Street N.W. to Dysprosium Street <br /> <br /> That all of the said improvementa shall be in accordance with the time table and <br /> plans and specifications therefor to be approved or prepared by the City <br /> Engineer. <br /> <br /> 3) That the Developer, being the sole owner of Lots 2 through 12 of Block 6; <br /> Lot 2, Block 3; Lots 2 and 3, Block 5; Lots 2 and 3, Block 7; and Lot 2, Block 9 all <br /> in Barthel's Rum River Acres 2nd Addition hereby agrees to permit the City to assess <br /> pursuant to M.S.A. Chapter 429 $1,058.82 on each of said lots. In return for these <br /> assessments the Developer's obligation to pave 164th Lane N.W. from Highway 47 to its <br /> intersection with the East line of Junkite Street N.W. and Junkite Street N.W. from <br /> 164th Lane N.W. to its intersection with the North line of Barthel's Rum River Acres <br /> 2nd Addition, which requirement was originally provided for in Paragraph 2) a) & c) of the <br /> Performance Contract between the parties hereto dated October 12, 1979 will not be <br /> required. This provision is entered into as the parties agree that the cost of <br /> paving said 164th Lane N.W. from Highway 47 to Junkite Street N.W. and Junkite Street <br /> N.W. from 164th Lane N.W. to its intersection with the North line of Barthel's Rum <br /> River Acres 2nd Addition would be $18,000.00 (17 Lots x 1,058.82). <br />~~ 4) That 162nd Lane N.W. from Germanium Street N.W. to Dysprosium Street N.W. is <br /> unnecessary and the City agrees to commence a vacation procedure to have this portion <br /> of 162nd Lane N.W. vacated. <br /> <br /> <br />
