DEVELOPER hereby waives all right to a public hearing and other statutory fights or <br />City Charter fights granted a property owner relating to special assessments, including the <br />fight to appeal the special assessment for installation of the improvements described in this <br />paragraph. In addition, the DEVELOPER grants the fight to the CITY to enter on each <br />lot of the Plat in order to install the improvements described in this paragraph, in the event <br />it is necessary for the CITY to install these improvements and specially assess the same. <br /> <br />III. <br /> <br />PERMITS, OCCUPANCY AND PROPERTY VALUES: <br /> <br />14. Requirements for Building Permits. No occupancy permit for any lot in the Plat <br /> shall be issued until (a) vehicular access to the lot is provided including the installation of <br /> Class V material on ail streets in the Plat; (b) site plan approval is granted by the CITY and <br /> any additional expense incurred in giving site plan approval has been reimbursed to the <br /> CITY; (c) a Certificate of Survey, including that information required by the CITY, has <br /> been supplied to the City Building Official; and (d) all the f'mancial guarantees required by <br /> the CITY have been satisfied. <br /> <br />15. Requirements for Plumbing. As a part of the plumbing requirements, back:flow <br /> preventers shall be installed in each sewer line. <br /> <br /> IV. <br /> <br /> PARK DEDICATION: <br /> <br />16. Cash Contribution. Park dedication shall be satisfied by the DEVELOPER making a <br /> cash Contribution in the amount of Six Thousand Four Hundred Fifty Four Dollars and <br /> Fifty Cents ($6,454.50), which represents Two Hundred Fifteen Dollars and Fifteen Cents <br /> ($215.15) for each of the thirty (30) lots planned for in the original preliminary plat, in <br /> accordance with the development agreement for Chestnut Hill Addition and for the. <br /> <br />It is herein agreed by the DEVELOPER and the CITY that the two additional lots gained <br />in Chestnut Hills 4th Addition as a result of the April i3; i993 revision to the preliminary <br />plat of Chestnut Hill shall not be subject to the terms of the Chestnut Hill Development <br />Agreement as it pertains to a Two Hundred Dollar and no cents ($200.00) park and trail <br />assessment or the Two Hundred Fifteen Dollar and fifteen cents ($215.15) cash <br />contribution due at the time of final plat approval.
