CASE <br /> <br />INTRODUCE ORDINANCE TO REDUCE THE SIDE YARD SETBACK <br />REQUIREMENT IN THE R-1 URBAN RESIDENTIAL DISTRICT <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In May, the developer of Amber Ridge approached City Council regarding a hardship they were <br />encountering in meeting the 10 foot side yard setbacks. They explained that the market demand is <br />for homes with triple attached garages and they cannot construct those styles of homes on an <br />average urban lot in Ramsey and simultaneously maintain the 10 foot side yard setback on both <br />sides of the property and the architectural integrity of the home. The Council directed that the <br />Board of Adjustment conduct a special meeting to consider a four (4) foot variance to the side yard <br />setback on the garage side for the lots in Amber Ridge. The Council also directed that the Planning <br />and Zoning Commission initiate action to reduce the side yard setback on the garage side from ten <br />(10) feet to six (6) feet. <br /> <br />Observations: <br /> <br />The Board of Adjustment met on June 7 and granted a 4 foot variance to the I0 foot side yard <br />setback on the garage side of properties in Amber Ridge. <br /> <br />Staff researched side yard setbacks in other communities. Andover, Anoka, Blaine, Champlin and <br />Coon Rapids all have 5 foot setbacks on the garage side; Elk River has a 6 foot setback on the <br />garage side. Ramsey's Building Official recommends a 6 foot side yard setback on the garage side <br />to avoid construction right on the line of the standard 5 foot wide utility easements along side <br />property lines. <br /> <br />The Planning Commission met on July 6 and conducted a public hearing and recommended <br />Council approval to amend City Code to reduce the side yard setback from 10 feet to 6 feet for the <br />uninhabitable portion of sumcmres in the Urban Residential district. The proposed ordinance is <br />enclosed for your review. <br /> <br />Also at the July 6 meeting, Commissioner Deemer introduced a motion to reduce the structure <br />setback from thoroughfares from 110 feet to 83 feet. Staff recommended that this issue be <br />researched but the Commission voted unanimously in favor of reducing the thoroughfare setback. <br /> <br />Recommendation: <br /> <br />The Planning Commission recommends reducing the side yard setback to six feet for the <br />uninhabitable portions of structures and the structure setback from thoroughfares to 83 feet. Staff <br />recommends only reducing the side yard setback at this time and directing staff to research the pros <br />and cons of reducing the thoroughfare setback. <br /> <br />Council Action: <br /> <br />Motion to: <br />Introduce Ordinance g93- reducing the side yard setback in the R-1 Urban Residential <br />Diswict to six (6) feet and reducing the thoroughfare setback to 83 feet. <br /> <br /> <br />
