19. 20. 21. 22. 23. The use of wailers, trucks or vehicles for long tam storage (longer than 30 consecutive days) is prohibited. All vchictcs and traitors on site must bear a current license, be registered, and must be mad worthy. The placement, design and consmaction of new structures or additions to existing structures and sim improvements shall comply with City Code and applicable state codes and OSHA requirements. The Permit Holder agrees to connect to City sewer and water at the time sewer and water is extended to the area and herein agrees to join in a petition for such improvements when such petitions are presented. In the event this CUP is revoked or the Permit Holder closes operation of the facility for any reason, including but without Iimitation, by order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, the Perugt Holder shall immediately proceed to remove all materials from the site. In the event the Permit Holder fails to comply with the terms of this CUP, thc City may, upon 30 days' written notice to the Permit Holder, enter into thc property and perform all such obhgarions, the costs of which shall be borne by the Permit Holder or, in default thereof, by its surety. Danny's Tranny's, Inc. shall submit financial assurances as follows: (a) Charges and Fees. Danny's Tranny's, Inc. agrees to pay to the City upon the issuance of this CUP a fee in an amount sufficient to reimburse the City for engineering, legal and administrative expenses reasonably incurred during the consideration and development of this CUP. The Permit Holder shall maintain a minimum balance of Five Hundred Dollars ($500.00) in the CUP escrow account and shall reimburse the City for all fees incurred by the City in connection with inspection of the facility and ~dministration of this CUP. In the event the City incurs additional reasonable costs occasioned solely by the presence of this use within the City of Ramsey for personnel training, specialized equipment, risk insurance or increased contract costs for providing fmc department services, the Permit Holder agrees to reimburse the City at cost upon presentation of supporting documents and invoices consistent with apphcable law. (b) Liability Insurance and Liability Indemnification. The Permit Holder shall secure and maintain insurance fi.om an insurance company acceptable to the City and authorized to write casualty insurance in the State of Minnesota wi-rich will protect the Permit Holder, its agents and employees and the City fi'om claims for bodily injury, death or property damage which may arise from the operations on the Subject Property. The Permit Holder shall file a certificate of insurance or a certified copy of the insurance pohcy with the City. Such insurance policy shall contain a clause providing that it shall not be cancelled by the insurance company without thirty (30) days' written notice to the City of intention to cancel. The following coverages shall be provided in mounts not less than those specified: i. Public Iiability, general liability, personal injury and property damage: (1) (2) (3) (4) Injury or death of one person - $1,000,000. Injury to more than one person in a single accident - $1,000,000.
