CASE REQUEST TO REZONE CERTAIN PROPERTY FROM B-1 BUSINESS TO R-1 RURAL RESIDENTIAL; CASE OF WAYNE JOHNSON, NORTH LAKE PROPERTIES By: Zoning Administrator Sylvia Frolik Background: Wayne Johnson of North Lake Properties has submitted an application to rezone the property at the southwest comer of the intersection of Hwy. g47 and 153rd Avenue N.W. from B-1 Business to R-1 Rural Residential. Mr. Johnson's intent is to develop the property with single family urban residential lots when the property is brought into the MUSA. When the property is brought into the MUSA, the zoning would automatically change from R-1 Rural Residential to R-1 Urban Residential. The following items are enclosed for your information: a) b) Site location map Sketch plan for proposed future subdivision Observations: The subject property is part of an intersection that the City's Comprehensive Plan has targeted for development with a neighborhood center. Additionally, the City has received approval to use a portion of the 1993 Community Development Block Grant funds to update its land use plan. It is anticipated that work will commence on this task in early August. The Planning and Zoning Commission conducted a public hearing regarding the request for rezoning. At that meeting, City Staff recommended tabling Mr. Johnson's request until the land use plan update is complete. To table the request will require Mr. Johnson's cooperation. Mr. Johnson stated his willingness to delay action on his request until the land use update is complete and if it is accomplished in a reasonable time frame. Recommendation: City Staff and the Planning and Zoning Commission recommend tabling action on Mr. Johnson's request for rezoning. Council Action: Motion to: Table action on Wayne Johnson's request for rezoning until such time as the City has completed updating the land use element of its Comprehensive Plan.
