STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES: City Code Compliance. That the DEVELOPER will develop the Plat in accordance with the City Code, Section 9.50, entitled "Subdivision. Conformance with Plan. The Plat shall be developed pursuant to the final plat consisting of one (I) sheet, prepared by Cherrier Land Surveyors, Inc., entitled Chestnut Woods and received by the CITY on July 20, 1993. Incorporation of All City Code Requirements. That the recitals above and the provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY, as mended to date hereof, are incorporated herein by reference. Stage I Improvements Required. Improvements shall consist of water, sanitary sewer, gas, telephone, and electric lateral facilities necessary to service the additional lot created. It is understood that ail of the above laterals can be installed without disrupting existing City streets. The DEVELOPER shall be responsible for al1 costs associated with the installation of these improvements. Installation of the improvements wiI1 be in conformance with specifications as directed by the City Engineer and subject to his inspection. - Boulevard and Area Restoration. The DEVELOPER shall be responsible for the cost of establishing seed or sod in all boulevards within thirty (30) days of the completion of the Stage I improvements, and restoring all other areas disturbed by the development grading operation. The DEVELOPER shall also be responsible for the cost of cleaning any soil, earth or debris from the wetlands within and adjacent to this Plat resulting from grading performed in the development of the land Requirements .After Stage. I Improvements, After the Stage 1 improvements are installed, the DEVELOPER shall clear any soil, earth, or debris from the s~eets and from the lots within the Plat resulting from any construction on the Subject Property by the DEVELOPER or their successors and assigns. Stage I Improvements Completion Date, The Improvement completion date shall be on or before September 30, 1993.
