16. Access to Lots. <br /> N.W. <br /> <br /> GENERAL <br /> <br />All lots in the plat shall be restricted from access onto Nowthen Blvd. <br /> <br />17. Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in the <br /> Plat prior to issuance of a Certificate of Occupancy. In accordance with the policy <br /> established by the City of Ramsey Park and Recreation Commission on June 10, 1993, the <br /> DEVELOPER shall submit a tree preservation plan for CITY approval that identifies <br /> existing tree growth within the Plat that will be preserved during construction. Said plan <br /> shall also include provisions for the planting of one two-inch diameter tree (or equivalent <br /> thereof) of an approved species at the road frontage or in the front yard of each of the lots <br /> in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is <br /> not conducive to tree or sod planting at the time of Certificate of Occupancy, the <br /> DEVELOPER shall place a cash deposit in the amount of $200.00 for trees and $100.00 <br /> for sod in an escrow account with the CITY and upon verification of the planting being <br /> accomplished, said cash deposit shall be refunded to the DEVELOPER. Failure of the <br /> DEVELOPER to comply with the planting requ/re~ment w/thin a reasonable time frame <br /> following a determination by the CITY that weather conditions are conducive to planting <br /> shall give the CITY authority to cause the planting, the cost of wh/ch shall be charged to <br /> the Plat escrow account and the DEVELOPER shall not be eligible for a refund of the <br /> cash deposit made for this purpose. <br /> <br />18. Tree <br /> <br /> Disease Prevention and DisDosal. The DEVELOPER shall prevent the <br />inu-oduction and spread of tree disease into the residual tree populations of the Plat and <br />adjoining properties and reduce the impacts of construction on the residual property of the <br />Plat and adjoining properties. The DEVELOPER in order to accomplish in accordance <br />with "Protecting Trees From Construction Darr~, ge" (attached hereto as Exhibit 'A'), shall: <br /> <br />Install physical barriers, such as snow fence, around trees that are to rema/n.
