with the requirements for a certificate of occupancy and the terms and time frames <br />established within the Building Moving Permit. <br /> <br />Whenever in judgement of the City, the project has not been completed in accordance with <br />Uniform Building Code requirements for issuance of a certificate of occupancy, a written <br />notice shall be issued to the fee title owner of the subject property identifying the necessary <br />corrections. Service of said notice shall be in person or by mail. If the premises are not <br />occupied and the address of the fee title owner is unknown, service on the owner may be <br />had by posting a copy of the notice on the premises. If the necessary corrections are not <br />accomplished within ten (10) days of the date of issuance of said notice, the City Council <br />may cause such conditions to be abated at the expense of the City and recover such <br />expenditure, plus 25% of such expenditure, either by civil action against the fee tide owner <br />of the subject property or by ordering the administrator/clerk to extend such sums, plus <br />25% thereof as a special tax against the property upon which the structure is located and to <br />certify the same to the county auditor for collection in the manner as taxes and special <br />assessments are certified and collected. <br /> <br />Subd. 8 Fees, Escrows and Financial Guarantees <br /> <br />The City Council shall establish the amount of application and escrow fees and <br />financial guarantees by resolution. <br /> <br />The form of the financial guarantee shall be a cash deposit or an irrevocable Letter <br />of Credit, approved as to form by the City, and the amount of which shall be <br />determined by the City Council on an individual case basis. The financial guarantee <br />shall be in force and effect until all required construction has been satisfied and alt <br />costs incurred by the City have been reimbursed. <br /> <br />The applicant and/or fee title owner of the subject property shall be responsible for <br />all costs incurred by the City, which expenses shall include but not be limited to <br />expenses for engineering, legal and administration. Said expenses shall be paid <br />within fifteen (15) days of billing by the City. Failure to pay the City expenses <br />within fifteen (15) days will permit the City to draw upon any of the escrows <br />required by the City. <br /> <br />The applicant and/or fee title owner shall be responsible for all building permit fees <br />and other fees as required. <br /> <br />Escrows shall not be closed and no credit balances in these accounts shall be <br />refunded to the applicant until there has been a satisfactory final inspection of the <br />building and all City costs in administering and enforcing the Building Moving <br />Permit and Building Permit have been reimbursed. <br /> <br />SECTION 3. SUMMARY <br /> <br />The following is the official summary of Ordinance g'93-__, which has been approved by <br />the City Council of the City of Ramsey as clearly informing the public of the intent and <br />effect of the ordinance. <br /> <br />Section 8.35 shall be added to the Ramsey City Code to establish regulations and <br />procedures for moving single family dwelling units into or within the City of Ramsey. It <br />shall require a Building Moving Permit to move a dwelling into or within the City of <br />Ramsey. Said permit must be reviewed by the Planning and Zoning Commission and <br />approved by the City Council.
