Councilmcmber <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br /> PROPOSED RESOLUTION ~g93-10- <br /> <br /> A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br /> PERMIT TO ESTABLISH A TOWING SERVICE AND AUTO REPAIR FACILITY <br /> IN THE INDUSTRIAL DISTRICT <br /> <br /> WHEREAS, Champlin Towing, Inc. has properly applied for a conditional use permit to <br /> establish a towing service with impound lot and an auto repair facility on the property generally <br /> known as 14300 Sunfish Lake Blvd. N.W. and legally described as follows: <br /> <br /> That part of the East 500 feet of the Northeast Quarter of the Southeast Quarter of Section <br /> 27, Township 32, Range 25, Anoka County, Minnesota lying north of the South 400 feet <br /> thereof and lying south of the North 750 feet thereof (as measured along the south and east <br /> lines thereof); except road; subject to easements of record; and <br /> <br /> WHEREAS, the Planning and Zoning Commission met on October 5, 1993, conducted <br /> the public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOT.~q.-as follows: <br /> <br />1. Based on Findings of Fact #~, a conditional use permit to establish a towing service <br /> with impound lot and an auto repak facility is hereby granted to Champlin Tow/ng, Inc., <br /> hereinafter referred to as "Permit Holder", at 14300 Sunfish Lake Blvd. N.W. <br /> <br />2. The facility shall be developed in accordance w/th the Site Plan drawn by CD Systems of <br /> St. Paul, Inc. and dated 9/14/93, except that the following specifications are to be met. The <br /> perimeter of the impound lot shall be fenced and wherever chain link fence is used, a tree <br /> screening shall also be established to screen the outside storage from neighboring uses. <br /> The east fence 1/ne of the impound lot shall consist of a six (6) foot high wood privacy <br /> fence. Additional trees shall be planted Ln the front lawn to intensify screening the impound <br /> lot from view of the publ/c fight-of-way of Sunfish Lake Blvd. N.W. <br /> <br />3. All plantings of tree screening described in Item #2 shall be completed within one (1) year <br /> of the date that the conditional use permit is approved and plant materials shall be <br /> maintained and replaced as necessary on a permanent basis. The number of trees to be <br /> planted shall such that the impound lot is sufficiently screened from neighboring uses and <br /> the public right-of-way as determined by the City Eng/neer. <br /> <br />4. That the Permit Holder shall be required to implement best management practices to <br /> eliminate or reduce the potential for contamination of storm water and/or groundwater. At a <br /> minim/m, these best management practices shall include the application of a blacktop <br /> sealant to the area of the impound lot, with reapplications as necessary. In addition, the <br /> Permit Holder shall collect and capture all spills at the site and said materials shall be <br /> disposed of in accordance with current regulations. <br /> <br />5. That the Permit Holder shall accept all responsibility for maLntaining the impound lot and <br /> auto repair facility in accordance with Anoka County Environmental and Minnesota <br /> Pollution Control Agency regulations. <br /> <br />6.
