Goodrich, city Attorney~ <br />City/WM~iI 1988 Development (Ski Rill) Agreement <br />March 19, 1993 <br /> <br />Pursuant %o your request on March 9, 1993, I am submitting the <br />following as a summary review of the Developmen~ Agreement (the <br />"Agreement"). <br /> <br />I. PURPOSE OF AGREEMENT: <br /> <br />To construct ski hill and sledding area, one tow rope, warming <br />house and adjacent parking facilities and rough grade 153rd road <br />right-of-way in conjunction with vertical expansion of landfill. <br />City states in the Agreement that ski hill development and the <br />rough grade of road right-of-way will be in ~he public interest, <br />provide amenities to City, will enhance the end use of the property <br />and will De of service no citizens of City and surrounding areas. <br /> <br />II, "IMPROVEMENTS', PER AGREEMENT: <br /> <br />(a) Vertical E~pansion: <br /> <br />Required WMEI to prepare CUP aDP!ication and related <br />documents and required City to hold public hearings and <br />approve or deny CUP. The City approved the CUP and <br />issued same on November 15, 1988. Upon granting the CUP, <br />~he City is entitled to enforce the Agreement in <br />accordance .with its terms. <br /> <br />(b) Borrow i~reas: <br /> <br />WM/4I permitted to take Borrow from the north 50 acres. <br /> <br />WMMI to commence work in Eastern Borrow area on or after <br />March 31, 1988 and complete by December 3!, 1991 and <br />complete work in Western Borrow area by December <br />1992. <br /> <br />(c) glean-uR _.Day: <br /> <br />kR~MI to sponsor clean-up day annually until vertical <br />expansion completed. <br /> <br /> <br />
