APPENDIX V <br />(Note- This form of Permit and Agreement is executed when Mn/DOT purchases and provides materials and a <br />Cooperative Agreement with similar language is executed when Mn/DOT provides funds directly to the local unit of <br />government.) <br /> <br /> STATE OF MINNESOTA <br />DEPARTMENT OF TRANSPORTATION · <br />LANDSCAPE PARTNERSHIP PERMIT AND AGREEMENT <br /> <br />A Permit is hereby granted by the State of Minnesota, Department of Transportation ("Department"), to the City of <br />La Crescent ("City"), for the purpose of installing and maintaining various landscaping features on the right of way <br />of Trunk Highway No. 61 ("Lands"), as shown on the exhibit attached hereto and made a pm of.this permit and in <br /> <br />accordance with the special provisions listed below. .............. : .......... . .......... ~ ~:.' -. <br /> <br />This permit is granted under the terms of the 'Community Roadside Landscaping Partnership Program' of the <br />Minnesota Department of Transportation. 'The program is intended to allow beautification and landscape enhance- <br />ment of State fight of way through cooperative effort of the Minnesota Department of Transportation and local <br />units of government. The local unit of government acts as the sponsor or responsible agency under the terms of this <br />permit and may enlist the assistance of others to fulfill its responsibilities. In this project, the City of La Crescent is <br />the responsible local unit of government. <br /> <br />The following Special Provisions apply to this project: <br /> <br />SPECIAL PROVISIONS <br /> <br />1. This permit and agreement is granted only for the purpose of conducting the following activities within the right <br /> <br />o <br /> <br />of way of Highway 61 as shown on the attached exhibit. <br /> <br /> Installation of wooden planter boxes <br /> <br /> Placement of 250 shrubs and wood chip mulch <br /> Perpetual maintenance and repair, including removal and/or replacement if necessary, of ali of the above <br /> features.- <br /> <br />Use of the areas shall in no way impair or interfere with the safety or convenience of the traveling public in its <br />use of the highway. <br /> <br />Maintenance and replacement responsibitities shall include those features which were provided and/or installed <br />by the Minnesota Department of Transportation and shall be performed in accordance with the attached lists <br />and calenders of required maintenance activities (Tables Ia, lb, 2a, 2b, 3, 4 and 5.) <br /> <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> <br />I <br />I <br />I <br />I <br />i <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
