I <br /> I <br />! <br />I <br />I <br />i <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE # I <br /> <br />CONSIDER REVOCATION OF CONDITIONAL USE PERMIT FOR LOTS 2, 3 <br /> AND 4, BLOCK 4, GATEWAY NORTH INDUSTRIAL PARK PLAT 2; <br /> CASE OF DANNY'S TRANNY'S <br /> By: Zoning Administrator Sylvia Frollk <br /> <br />Background: <br /> <br />In May of this year, Dan Karst applied for a conditional use permit to disassemble engines and <br />transmissions and conduct wholesale activities on Lots 2, 3 and 4 of Block 4, Gateway North <br />Industrial Park Plat #2. The proposal included the construction of a 12,500 square foot building to <br />provide for an all-enclosed operation. The site plan for the new construction was also approved by <br />City Council. <br /> <br />Observations: <br /> <br />On October 7, 1993, Dan Karst applied for a building permit for the new structure on Lot 2. That <br />building permit has been ready since October 18 but cannot be released until Mr. Karst provides <br />the $46,680 financial guarantee for site improvements called for in the Site Plan Development <br />Permit. The Site Plan Development Permit requires that the site be developed by June 30, 1994. <br />With the exception of applying for the building permit, Mr. Karst has not taken any action to <br />construct the required building on Lots 2, 3 and 4; yet operations relating to his aluminum <br />recycling activity on Lot 1 have extended onto these lots. This extension of operations prior to the <br />construction of the building and the outside storage of inoperable equipment, debris, and feedstock <br />preparation constitute violations of the conditional use permit.issued for Lots 2, 3 and 4. <br /> <br />You may recall that Mr. Karst's amended conditional use permit for Lot 1 and new conditional use <br />permit for Lots 2, 3 and 4, seriously hinged on whether or not he brought Lot 1 into compliance <br />with his current CUP and cleaned up Lots 2, 3 and 4. He put forth the effort and received his <br />approvals. Since that time, he has resumed methods of operations that are flagrant violations of his <br />conditional use permit and allowed the condition of premises on Lots 2, 3 and 4 to again decline to <br />a totally unacceptable level. <br /> <br />On a drive by inspection on December 6, it was noted by Staff that clean up efforts apparently have <br />been initiated, however, Lots 2, 3 and 4 were not totally cleared of debris, inoperable vehicles and <br />feedstock preparation activity. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br /> <br />d) <br />e) <br /> <br />g) <br /> <br />Site location map <br />Conditional Use Permit issued to Danny's Aluminum Processing, Inc. <br />"Update on status of operations at Danny's Aluminum Processing which includes <br />statements regarding condition of premises on Lots 2, 3 and 4. <br />Letter from Bob Brown of Production Design Products dated October 19, 1993 <br />Letter from Sylvia Frolik to Dan Karst dated October 27, 1993 <br />Inspection report for December 6, 1993 by Sylvia Frolik <br />Letter from Sylvia Frolik to Dan Karst dated December 6, 1993 <br /> <br /> <br />
