as the size is consistent with other lots in Rodeo Hills. <br /> <br />The Commission discussed the buildability of the lots with respect to the <br />percolation tests. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Howell to <br />recommend approval of Mr. Borchert's request for a minor subdivision to <br />change Outlots C and D in Rodeo Hills to platted lots. <br /> <br />Further Discussion: Commissioner Howell noted that the Park Commission has <br />recommended a cash payment to satisfy park dedication requireme~ts. <br />Commissioner Hendriksen noted that the city could be held liable for <br />creating a lot that is unbuildable and be obligated to grant a variance for <br />a mound system in order to resolve the matter; the number of failing septic <br />systems in Rodeo Hills makes the question of buildability in that area a <br />real issue. Commissioner Shumway noted that there has been no report of a <br />mound septic system failure in Rodeo Hills. Commissioner Howell called for <br />a vote. The Commission noted that approval of the minor subdivision <br />includes approval of the lot sizes proposed; variances will still be <br />required for the mound setic systems. <br /> <br />Motion carried. Voting Yes: Commissioners LaDue, Howell, Shumway and <br />Terry. Voting No: Chairman Zimmerman, Commissioners Hendriksen and Holm. <br /> <br />Chairman Zimmerman and Commissioners Hendriksen and Holm stated that their <br />'no' votes are based on their concerns with setting a precedent of allowing <br />one acre lot sizes and creating lots with poor soils. <br /> <br />Case #5: Request For Minor Subdivision; Case Of Mr. Art Bulow; <br /> <br />Mr. Otto stated that Mr. Bulow is requesting a subdivision of one lot of <br />record split in two by the extension of Front Street into one lot north of <br />Front Street and two lots south of Front Street. Mr. Otto stated that Mr. <br />Bulow was agreeable to dedicating a 35 foot easement for the future <br />Mississippi multi-use trail system to satisfy the City's park dedication <br />requirements. Mr. Otto stated that Council may want to require park <br />dedication consistent with that required in the Riverview Estates plat (an <br />additional 3 feet of right-of-way adjacent to Front Street right-of-way). <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Holm to <br />recommend approval of Mr. Art Bulow's request for a minor subdivision with <br />park dedication consistent with that required of Riverview Estates and <br />contingent upon EQB and DNR approval of Ramsey's proposed amendment to the <br />Critical River Corridor Ordinance. <br /> <br />Motion carried.
