Case #3 <br /> <br />STATUS OF TRAIL DEDICATION/PLAT FOR BULOW'S ADDITION <br />AND RIVERVIEW ESTATES ADDITION <br /> By: Mark S. Banwart, Community Development Director <br /> <br />Background: <br /> <br />On August 20, 1988, the Parks and Recreation Commission approved a motion that the City aquire <br />35 foot easement through both the Bulow's Addition and Riverview Estates Addition to satisfy the <br />Park Dedication requirements. The 35 foot easements would be in the form of a multi-use trail. <br /> <br />At the November 15/16, 1988 City Council meeting, the Council approved the final plat of <br />Riverview Estates Addition contingent upon DNR and I~QB approval of the proposed amendment to <br />the Critical Rivers Ordinance. The resolution for the final plat approval was amended as follows: <br /> <br />(c) <br /> <br />Indicate that Park Dedication be provided in the form of cash payment in <br />accordance with Park Dedication requirements in effect at the time of the <br />subdivision application, an additional three (3) feet of right-of-way adjacent to the <br />existing street right-of-way being provided and a tax payment in leiu of <br />constructing and eight (8) foot bituminous trail the length of the property. <br /> <br />Also at this Council meeting, Bulow's Addition (minor subdivision) was also approved. <br />resolution for the approval was amended as follows: <br /> <br />The <br /> <br />1-B <br /> <br />Mr. Bulow provide Park Dedication as required by the City Council at their <br />November 16, 1988 meeting which indicates an additional three (3) feet of right-of- <br />way along Front Street and remaining in cash payment... <br /> <br />1. Developer shall provide a ten (10) foot easement on the Westerly lot. <br /> <br />On November 23, 1988. the City sent a letter to the Environmental Quality Board (EQB) requesting <br />that both the plats be temporarily withdrawn from the review process. The letter also requested <br />that both of these plats be reinstated in the review process so that comment can be received by <br />December 7, 1988. These comments will concern the establishment of trail/sidewalk standards <br />and other agency review comments. These standards can be used for the trail corridor area, which <br />in time, will be a part of the Regional Trail Corridor System and run parallel with the Mississippi <br />River.
