Cur Missltim: Tr, wort together ko respotibiy grow our community, and to provide quality, cost-effective, and efficient government services. <br />CC Regular Session 4. 7. <br />Meeting Date: 04/28/2015 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title: <br />Adopt Resolution #15-04-103 Granting Approval of Final Plat for Brookfield 6th Addition; Case of Brookfield <br />Land, LLC and Capstone Homes, Inc. <br />Purpose/Background: <br />Brookfield Land, LLC has applied for Final Plat approval of BROOKFIELD 6TH ADDITION. The Final Plat <br />consists of eighteen (18) lots plus an outlot and is the second phase of a Preliminary Plat that was approved by the <br />Planning Commission on October 3, 2013 and City Council on October 22, 2013. This plat is a continuation of the <br />original Brookfield Addition west of Nowthen Boulevard and generally north of 161h Avenue. <br />Notification: <br />In accordance with City Code, only City Council approval is required for a Final Plat without a Public Hearing. <br />Observations/Alternatives: <br />The site is guided Low Density Residential (LDR) on the Comprehensive Plan and is located in the R-1 Residential <br />(MUSA) district. As outlined in the attached technical review memo, the proposed subdivision conforms to all <br />minimum standards of the City's Zoning Code. The Final Plat is consistent with the approved Preliminary Plat. <br />The Landscape, Grading, Street, and Utility Plans generally conform to the City's minimum standards, with <br />necessary revisions as outlined in the Staff Review Letter. However, of note is that this project will connect with an <br />existing segment of 168th Avenue that currently terminates in a cul-de-sac as was stipulated at the time of <br />Preliminary Plat approval. The City will be reconstructing the existing segment of 168th Avenue this summer and <br />coordination between the two project will be critical. <br />The Developer will also be required to execute the draft Development Agreement as attached agreeing to construct <br />the improvements required by City Code Chapter 117 and securing the necessary sureties to ensure proper <br />installation in the event of a default. The Developer's Engineer is compiling a detailed cost estimates for the <br />required improvements but were not yet available as of the writing of this case. A DRAFT Development <br />Agreement is attached, but formal action on a Development Agreement will occur at a future meeting once it is <br />finalized. <br />At the time of Preliminary Plat Review, the status of the existing Home Owners' Association was discussed in great <br />detail. The intent of the HOA was to cover ongoing operation of the original private amenities (entryway <br />landscaping, pond liner, and private park). A fact sheet with additional details is available upon request. Consistent <br />with the first thirty-two (32) lots created by Brookfield Land, it is not anticipated that these newly created lots will <br />be added to the existing Home Owners' Association. <br />
