Exhibit C <br />Trail Easement <br />PERMITTEE acknowledges that Temporary Trail Easement for a temporary trail exists on Outlot <br />A, Brookfield 2nd Addition. PERMITTEE agrees to secure written concurrence from 21st Century <br />Bank, owner of Outlot A, Brookfield 2nd Addition, that a replacement, perpetual trail easement <br />will be executed to allow the construction of a permanent trail connection from the extension of <br />168th curve to the existing bituminous trail along Trott Brook. The CITY agrees to work through <br />the design and subdivision process to avoid conflicts with future development. <br />
