CC Regular Session 4. 8. <br />Meeting Date: 04/28/2015 <br />By: Bruce Westby, Engineering/Public <br />Works <br />Information <br />Title <br />Adopt Resolution 15-04-108 Approving Right of Entry Agreement for Construction of the Highway 10 and <br />Armstrong Boulevard Interchange <br />Purpose/Background: <br />Purpose: <br />Anoka County is requesting that the City of Ramsey adopt Resolution 15-04-108 for the purpose of allowing the <br />County to complete work on certain City owned properties, right-of-ways and easements while constructing the <br />Highway 10 and Armstrong Boulevard Interchange. <br />Background: <br />The City of Ramsey owns numerous properties, right-of-ways, and easements throughout the Highway 10 and <br />Armstrong Boulevard Interchange project area. Anoka County is requesting that the City grant the County and their <br />agents and assigns right of entry across these properties, right of ways and easements while constructing the <br />interchange improvements. <br />Attached are two exhibits showing the parcels where right of entry is being requested. Exhibit A contains a listing <br />of the parcels, and Exhibit B maps the locations of the parcels. <br />Notification: <br />No notification was required for this case. <br />Observations/Alternatives: <br />Observations: <br />Anoka County is in the process of reviewing the attached Right of Entry Agreement drafted by the City Attorney. <br />However, due to the pending start of construction for the Highway 10 and Armstrong Boulevard Interchange <br />project, Council is being requested to adopt Resolution 15-04-108 to help avoid any construction delays. <br />Alternatives: <br />Alternative Action #1 — Motion to adopt Resolution #15-04-108 approving the attached Right of Entry Agreement <br />for construction of the Highway 10 and Armstrong Boulevard Interchange contingent on review and approval by <br />Anoka County staff and legal counsel. <br />Alternative Action #2 — Motion to adopt Resolution #15-04-108 approving the attached Right of Entry Agreement <br />for construction of the Highway 10 and Armstrong Boulevard Interchange contingent on review and approval by <br />Anoka County staff and legal counsel after the following modifications are made: <br />Alternative Action #3 — Motion to deny adoption of Resolution #15-04-108 at this time. <br />Funding Source: <br />The costs for the City Attorney to draft the attached agreement are proposed to be paid through the City Attorney's <br />annual retainer fund. <br />
