REVI~ ~A%~JS OF PENDING PLATS <br />WITH RESPECT TO PARK DEDICATION R~Q~S <br />By: Community Development Director Anne Norris <br /> <br />CASE %3: <br /> <br />Background: <br /> <br />At its meeting on March 10, the Park Commission tabled action on proposed <br />subdivisions with respect to park dedication requirements until the City <br />adopts an ordinance allowing the City to take both land and cash to satisfy <br />park dedication requirements. The Commission tabled action on the <br />following plats: R. J. Sybrant A~dition; R. J. Sybrant 2nd Addition; The <br />North Forty; Rambosek's Red Oak Estates; and Oakwood Hills. <br /> <br />At its March 17 meeting, the Planning and Zoning Commission requested that <br />the City Council consider adopting an emergency ordinance amending that <br />section of the subdivision ordinance regarding park dedication requirements <br />to allow the City to aequire a combination of land and cash to satisfy such <br />requirements. <br /> <br />The City Attorney reviewed this direction and determined that park <br />dedication requirements do not meet the criteria outlined in Section 3.06 <br />of the City Charter to qualify as an emergency ordinance. <br /> <br />The City Attorney has determined that the City cannot delay developers <br />pending the adoption of revised park dedication requirements. However, the <br />City Attorney has suggested that Staff may negotiate for both land and cash <br />to satisfy the City's park dedication requirements until the City amends <br />its current park dedication requirements. <br /> <br />Currently, City Staff is negotiating with the developers of the above- <br />mentioned plats to determine whether to acquire land and/or cash to satisfy <br />the City's park dedication requirements.
