Councilmember Reimann informed Mr. Thorson that at the time the <br />City informed Mr. Lee that the driveway was in violation, the City did have <br />jurisdiction and that the City still has jurisdiction because the County stated <br />they will go along with whatever decision is made by the City of Ramsey. <br />Mr. Thorson replied that the fact of the day is that the County has jurisdiction <br />now and the City would be operating illegally if they took any action on that <br />road now. Councilmember Reimann replied that the City has the right to request <br />that the County carry out our recommendation. Mr. Ruud stated that there is <br />no deed transferring the right of way to the County and the City of Ramsey <br />still owns the property. It will be a County road but the City of Ramsey still <br />owns the property. Mr. Thorson insists that condemnation procedure is called <br />for. Mr. Redepenning replied that normally that might be the case, but <br />considering the history of the driveway in question, the County will go along <br />with the decision made by Ramsey City Council, and that the County does not <br />have zoning authority. Mr. Thorson requested justification that the driveway <br />is in fact, illegal. Mayor Gamec informed him that he could refer to Ramsey <br />City Ordinance 170.038E. <br /> <br />Mayor Gamec called for a vot to the motion on the floor. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cox, Sorteberg, <br />Reimann and Van Wagner. Voting No: None. <br /> <br />Mayor Gamec stated that Mr. Lee's driveway will not be obliterated immediately <br />and that Mr. Lee will be allowed some period of adjustment. <br /> <br />Mr. Lee stated that about a block from his residence there is another home <br />with a driveway onto County Road #56. <br /> <br />Mayor Gamec informed Mr. Lee that the driveway to which he is referring is <br />only a temporary driveway and that the property owner must divert his driveway <br />onto Industrial Blvd. extention, when it is completed. <br /> <br />Mr. Lee then stated that he really needs the driveway he is being forced to <br />remove and that there are a lot more serious problems in Ramsey to be taken <br />care of rather than his driveway onto County Road #56. <br /> <br />Mr. Lee and his attorney left the meeting at this time. <br /> <br />City Council, Mr. Ruud and Mr. Redepenning then discussed the safety factors <br />involved in allowing access onto County roads and that more attention should <br />be paid to enforcing the policy regarding access onto County roads. <br /> <br />Council then proceeded to discuss the problems of commercial business operating <br />in residential areas. Councilmember Cox stated that it is unfair for a person <br />operating a business in a residential area to pay residential taxes versus <br />the person operating the same business in a commercial area to pay commercial <br />taxes, which creates a greater overhead for him and he cannot compete with <br />the businessman in the residential area.
