to pass upon the cost of the assessment to this particular parcel.

Motion carried. Voting Yes: Acting Mayor Reimann, Councilmembers Van Wagner,
Schlueter and Sorteberg. Voting No: None. Absent: Mayor Gamec.

Case #2: Zoning Violation; Case Of Mr. Tom Auel,.15327 Eland Street NW:

Mr. Schnelle stated that a complaint was received at the last C6uncil meeting
regarding this particular residence. City Staff visited the property and
took some pictures and are presenting those pictures tonight. Mr. Schnelle
further commented that the pictures do not do justice to Mr. Auel's residence,
that it is very neat.

Mr. Auel was present and stated that he owns a dod farm in Andover and due to
the economy the business has not been doing well and he was forced to sell
the family car. Mr. Auel stated that he has three children under the age of
3 and it is necessary for him to leave his pick-up at the residence at all
times in case of emergency. Therefore, he finds it necessary to drive one
of the business trucks back and forth to-work and it is more convenient to
drive the truck and flat bed. ~Mr. Auel stated that he hopes to replace his
family car very soon and it will not be necessary to have business trucks at
his residence.

Mr. Schnelle stated that the only complaints received at City Hall are from
Mr. Ed Reinke.

Councilmember Schlueter noted that the pictures show that all three vehicles
are at the residence and how often does this occur?

Mr. Auel noted that on the particular day the pictures were taken, there had
been a lot of rainfall, he cut and loaded the sod and stopped at home to
make phone calls to contractors ~rying to sell what he had to cut.

Motion by Councilmember Van Wagner and seconded by Councilmember Sorteberg to
table this case until the Council meeting scheduled for November 22, 1983.

Motion carried. Voting Yes: Acting Mayor Reimann, Councilmembers Van Wagner,
Schlueter and Sorteberg. Voting No: None. Absent: Mayor Gamec.

Case #3: Informational:

Council noted a letter from Waste Management Board regarding the section of
a preferred area for hazardous waste processing facilities. He noted that
the Board is conducting a meeting on October 27, 1983 to consider findings
and conclusions.

Councilmember Schlueter stated that it seems ambiguous to again restate their
findings and conclusions; we already know who Waste Management listens to
and who they don't listen to.

MAYOR/COUNCIL INPUT

Councilmember Reimann requested that City Staff look into installing a door
between the two meeting rooms on City Hall lower level because it is distracting
when two meetings are being conducted simultaneously.

Sp C/October 4, 1983
