Case #2: Boundary Fence Dispute; Case Of Mr. Kenneth Miller: <br /> <br />Mr. and Mrs. Kenneth Miller and Mr. Robert Hunt were present. <br /> <br />Mayor Gamec informed Mr. Miller that his problem is that his residence is <br />located in an Industrial zone and Mr. Hunt is not violating any codes for <br />that zone. <br /> <br />Mrs. Miller inquired if the fencing that Mr. Hunt is installing decreases <br />the value of her property. <br /> <br />City Attorney Goodrich recommended that the Millers explore that possibility <br />with their personal attorney, that this is a private issue between the <br />parties involved and Mr. Hunt is not violating any City law. <br /> <br />Case #3: Adoption Of Critical Areas And Wetlands Ordinance: <br /> <br />Mr. Jim Martin was present and stated that he hoped that the ordinance was not <br />so complicated that it would prohibit development. <br /> <br />Mr. Berg noted a correction on Page 2 of the Ordinance: Change 'Corps of <br />Engineers' to 'U.S. Fish and Wildlife Services'. <br /> <br />Motion by Councilmember Schlueter and seconded by Councilmember Van Wagner to <br />adopt Ordinance #83-8 approving the Critical Areas and Wetlands Ordinance. <br />(Please refer to ordinance file for Ordinance #83-8). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Motion by Councilmember Schlueter and seconded by Councilmember Van Wagner <br />to adopt Ordinance #83-9, an ordinance amending Chapter 170.01 of City Code <br />entitled "Zoning". (Please refer to ordinance file for Ordinance #83-9). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Case #4: Accepting Petition For Sanitary Sewer. And Water, Storm Sewer And <br /> Streets, Request For; Case Of NDH, Inc.: <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Reimann to <br />adopt Resolution #83-168 declaring adequcy of petition and ordering preparation <br />o'f report in the case of NDH, Inc.'s petition dated August 26, 1983 requesting <br />sanitary sewer, water, storm sewer and streets be extended to serve the <br />proposed Flintwood Hills Second Addition as described in this resolution. <br />(Please refer to resolution file for Resolution #83-168). <br /> <br />Further Discussion: Mayor Gamec requested that the City Engineer be sure <br />that the study is performed only on the area requested. <br /> <br />Motion carried.. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner.
