Mr. Berg replied that 6 of the lots, in the area of 170th.~ ~ere assessed for
improvements as 2% acre lots and the remaining total acreage of the PUD allowed
for the balance of the residential lots planned. Councilmember Sorteberg
questionned the fact that no park fee is going to be required. Mr. Berg replied
that the PUD ordinance states that that much open space banishes the park fee.
Councilmember Sorteberg stated that he could go along with that if it were a
park for all children to enjoy. Councilmember Schlueter noted that including
City park land in the PUD would be better use of that land than it's present
use.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann,
Schlueter and Van Wagner. Voting No: None.

Councilmember Schlueter inquired as to irrigation plans for the golf course.

Mr. Dorn replied that there will be an underground automatic irrigation system
with water coming from a deep well.

Motion by Councilmember Van Wagner and seconded by Councilmember Reimann to grant
preliminary approval of Rum River Hills PUD based on the findings of fact and
also on the Planning and Zoning Commission action taken on August 2, 1983 in
which they granted preliminary approval of said PUD.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann,
Schlueter and Van Wagner. Voting No: None.

Case #4: Reconsideration Of Public Utility Assessment Ordinance (Sanitrary
Sewer~ Water, Storm Sewer and Streets):

Mr. James Martin - 3740 Union Terrace Lane - Plymouth - Stated that he has
reviewed the proposed amendments to the assessment ordinance and encouraged
Council to adopt those amendments. Mr. Martin stated that landowners of
Ramsey property continue to pay taxes to educate the children of the community
and now the landowners need the help of Ramsey in order to be able to develop
that property -- we need sewer and water.

Dick Sieber - Marmoset - Stated that Council is aware of the opinion of the
residents and appealed Council to reconsider; not necessarily going all the
way back to requiring 100% of the developer but certainly not going with
15%.

Mayor Gamec pointed out that the amendments proposed allow for flexibility and
that the City still could require 100% of the developer.

Mr. Sisber replied that that is a pretty empty possibility.

Mayor Gamec noted that an Ad Hoc Committee was appointed and the City has
conducted numerouse meetings regarding the Public Utility Assessment Ordinance
and he now feels that the City has come up with an ordinance that is workable
and allows for regulation of expansion of utilities and that it is a document
that can be lived with for the life of the City.

Mr. Berg stated that after discussions with Mr. John Lillja, he is recommending
a couple of wording changes:

Section 170.039D, Paragraph (4): Delete - "The IPA shall consult with the

C/August 23, 1983
