Councilmember Kurak stated she is not interested in paying for an easement. However, the City <br />did make a big mistake and has to make restitution for the damage. As far as purchasing the <br />easement, it is not the City's responsibility to supply Mr. Bauer with a driveway, and she does <br />not know that the City is prepared to negotiate for a whole road at this time. <br /> <br />Councihnember Zimmerman stated there is no public purpose for a road. <br /> <br />Mayor Gamec directed Assistant Community Development Director Trudgeon and City Attorney <br />Goodrich to acquire the figures needed to make decisions. <br /> <br />The consensus of the Council was to have an appraisal completed on the Dusbabek and Kaas <br />properties. <br /> <br />Mi'. Dusbabek inquired if the appraiser will be independent or will work for the City. <br /> <br />City Attorney Goodrich replied it will be an independent appraiser that the City would pay for. <br />The property owners have the right to hire a different appraiser that would not be paid for by the <br />City. The appraisal will determine the value of the land before the trees were removed and after <br />their removal. It would also determine the value before and after an easement were to go <br />through. The Council will then have the tools to make a decision regarding what, if anything, the <br />City will do, and how they will negotiate. <br /> <br />Councihnembcr Kurak stated the City gave Mr. Bauer permission to do work and he went ahead <br />with his plans, and now he cannot proceed. The City will need to address that with Mr. Bauer as <br />well. <br /> <br />Mr. Bauer stated if he is required to bring the road through on 161~t Lane he will have an issue. <br />l-Ie was told to take the trees down and acquired costs to create the damage. He will wait until <br />they find out where everything is sitting. <br /> <br />City Attorney Goodrich advised the appraisal will take at least 60 days to be completed. <br /> <br />Ms. Kaas stated after the removal of the trees this has become a very busy area with motorcycles <br />and dirt bikes. She inquired if they have permission to block the area. <br /> <br />Mayor Gamec requested Mr. Bauer to block the area off and put up signs. He indicated the <br />property owners can notify the Police Department if anyone is trespassing. <br /> <br />Mr. Kaas inquired about the tree inventory that was supposed to be completed. <br /> <br />Assistant Community Development Director Trudgeon replied there had been discussions about <br />a tree inventory, however, he is not sure if that ever came about. <br /> <br />Mayor Gamec commented the appraiser would be able to make a determination regarding the <br />trees. <br /> <br />City Council Work Session/March 30, 2004 <br /> Page 6 of 12 <br /> <br /> <br />
