City Attorney Goodrich advised the customers have to be treated equally. He stressed the need to <br />follow through if someone does not pay a bill, or they will not be able to collect. <br /> <br />There was discussion regarding if the bills should be sent out by the City or by Connexus. <br /> <br />Councihnember Elvig stated in all rights the consumers had received the goods and should be <br />obligated to pay the bill. His problem is a couple of these bills are big enough that they could <br />push people out of business. He suggested they predetermine an amount to share with Cormexus <br />and be willing to discount that amount to solve this problem in a swift manner. <br /> <br />Public Works Director/Fire ChiefKapler noted Connexus did make an offer at one time that they <br />would of£er one year of meter reading at no charge, which equates to $50,000. <br /> <br />Consensus of the City Council was to do a three-year back bill on the Connexus utility billing in <br />the an~ount of $446,576.61, with the City discounting $100,000 and Connexus paying $100,000. <br />This agreement will need to be agreed upon by Connexus prior to billing the customers. <br /> <br />Finance Officer Lund questioned if the Council would like Connexus to pay the City $100,000 or <br />offer two years of meter reading se~wice. <br /> <br />Mayor Gamec replied it would be preferable to be paid up front, but this will need to be worked <br />out with Connexus. <br /> <br />2) Helicopter Ordinance <br /> <br />Comlnunity Development Director Frolik reported staff has been drafting an ordinance regarding <br />personal use heliports. MnDOT does not require licensing of any personal use landing areas <br />outside the five-mile radius of an airport, but the City can require a license and/or a conditional <br />use permit. She explained the draft of the proposed ordinance would accomplish the following: <br /> <br />· Establish ten-acre minimum parcel size for a heliport. <br />· Identify an acceptable noise level. Noise level standards are difficult to identify, <br /> however, a representative of M~ff)OT Aero Division will be folwvarding new standards for <br /> noisc levels. <br />· Require the aircraft operator to be licensed. <br />· Require written permission of the property owner. <br />· Grant the City the authority to determine if the use will unduly endanger persons or <br /> property. <br />· Rcquire landing pads to be hard surfaced. <br />· Grant the City authority to establish the hours of operation. <br />· Require the applicant to have liability insurance. <br /> <br />City Council Work Session/March 23, 2004 <br /> Page 4 of 5 <br /> <br /> <br />
