AMENDMENT TO <br />DECLARATION OF RECIPROCAL DRIVEWAY EASEMENTS <br />AND DRAINAGE AND UTILITY EASEMENTS <br />THIS AMENDMENT TO DECLARATION OF RECIPROCAL DRIVEWAY EASEMENTS AND <br />DRAINAGE AND UTILITY EASEMENTS (this "Amendment") is dated as of , 2015 by <br />and between the City of Ramsey, Minnesota (the "City") and the Residence at the COR <br />Apartments LLC, a Minnesota limited liability company (the "Lot 3 Owner"). <br />WHEREAS, the Housing and Redevelopment Authority for the City of Ramsey, a <br />Minnesota municipal corporation (the "HRA"), executed that certain Declaration of Reciprocal <br />Driveway Easements and Drainage and Utility Easements (the "Original Easement") dated April <br />30, 2012, which was filed for record in the Office of the Anoka County Registrar of Titles on May <br />3, 2012, as Document No. 508341.013 against the real property described on Exhibit A hereto <br />("Lot 3") and the real property described on Exhibit B hereto ("Outlot A"); and <br />WHEREAS, the HRA subsequently conveyed Lot 3 to the Lot 3 Owner; and <br />WHEREAS, the City subsequently undertook the statutory process to dissolve the HRA <br />and, as part of the dissolution process, the HRA transferred all of its real estate holdings, <br />including, but not limited to Outlot A, to the City; and <br />WHEREAS, the legal description of the "Lot 3 Easement Areas," as such term is defined <br />in the Original Easement, contains a scrivener's error, and the City and the Lot 3 Owner now <br />desire to correct such error. <br />NOW, THEREFORE, for valuable consideration, the receipt and sufficiency of which are <br />hereby acknowledged, the parties hereto desire to amend the Original Easement as follows: <br />1. The term "Lot 3 Easement Areas" as set forth in the Original Easement is <br />amended and restated in its entirety as set forth on Exhibit C attached hereto. <br />1 <br />
