Our Mistionc To work together to reipoiibly grew our comma nityr, and to provide quality, cert-oliBcdwe, and efficient government services. <br />CC Regular Session <br />Meeting Date: 07/28/2015 <br />Submitted For: Jo Thieling, Administrative Services <br />By: Jo Thieling, Administrative Services <br />7. 3. <br />Information <br />Title: <br />Introduce Ordinance #15-13 Amending Ordinance #15-04 Massage Businesses and Services by Deleting the <br />Insurance Requirements <br />Purpose/Background: <br />Purpose: The purpose of this case is to introduce an ordinance that would amend an ordinance adopted in January <br />relating to Massage Businesses and Services. <br />Background: In January, 2015, the City Council adopted Ordinance #15-04 amending Chapter 26 of the Ramsey <br />City Code - Licenses, Permits and Miscellaneous Business Regulations - by Adding Article XVIII, Massage <br />Businesses and Services. The purpose for adopting the ordinance was to implement a new regulatory structure for <br />massage therapists and massage establishments as part of an effort to prevent and eliminate criminal activity. The <br />ordinance imposes licensing requirements, regulates the conduct of massage therapists and businesses, allows for <br />City inspections, and sets forth procedures for denying, suspending or revoking licenses. Upon the effective date, <br />staff emailed the ordinance to MuniCode (The City's Code Host and Codifier) to be incorporated into our City <br />Code. MuniCode staff noted that section 26-859(e) referenced section 26-851(n)(1), and that there was no such <br />subsection. Upon further review by City staff, it was noted that the reference was to an insurance requirement. <br />Based upon Council discussion at the November 25, 2014 work session, (minutes attached to case) it had been <br />decided that the City should not be involved with requiring insurance; however, consensus was that a question <br />regarding whether or not the establishment had insurance be added to the application. The question was added to the <br />application; however, in editing the original ordinance, staff erred in not removing that section. <br />Ordinance #15-13 being presented this evening for introduction is a simple amendment to Ordinance #15-04 and <br />eliminates the insurance requirement. <br />Notification: <br />This does not change anything for the Massage licensing process; therefore, no notifcations were necessary. <br />Recommendation: <br />Staff is recommending Council introduce Ordinance #15-13 amending Ordinance # 15-04 by deleting the language <br />referencing insurance requirements. <br />Action: <br />Motion to introduce Ordinance #15-13 Amending Ordinance #15-04 Massage Businesses and Services by Deleting <br />the Insurance Requirements. <br />
