Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> RESOLUTION 04-03-070 <br /> <br />A RESOLUTION REQUESTING THE TAX FORFEIT PROPERTY KNOWN AS <br />OUTLOT A RIVERSIDE WEST BE RETAINED AS PUBLIC PROPERTY FOR THE <br />USE AS DRAINAGE AND UTILITY EASEMENT. <br /> <br /> WHEREAS, on September 11, 1998 deed number 189294 was issued to the City of <br />Ramsey for Outlot A, Riverside west subdivision as tax forfeit property for use in the straightening <br />and widening of 137th Avenue NW, and; <br /> <br /> WHEREAS, in the subsequent five years after obtaining this parcel the City has not <br />straightened or widened 177th Avenue NW, and; <br /> <br /> WHEREAS, tax forfeit property which is not in use after five years for its stated pm-pose <br />must revert back to the state, and; <br /> <br /> WHEREAS, said Outlot A would serve public purpose as a drainage and utility easement <br />in the event that repair or replacement of the Dolomite Street sewage lift station is necessary, and <br /> <br /> WHEREAS, the attached application for Approval of a NeTM Use of Tax Forfeited Land <br />makes possible an adjustment of the public use for which the tax forfeited property was obtained. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Engineer is hereby authorized and directed to submit an Application for <br />Approval ora New Use of tax Forfeited Lands for Outlot A Riverside West subdivision for <br />the new use of drainage and utility easement. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Elvig <br />Councilmember Zimmerman <br />Councilmember Cook <br />Councilmember Kurak <br />Councilmember Pearson <br />Councilmember Strommen <br /> <br />and the following voted against the same: <br /> <br />RESOLUTION 04-03-070 <br /> lof 2 <br /> <br /> <br />
