Councilmember Elvig introduced the following resolution and moved for its adoption: RESOLUTION 04-03-070 A RESOLUTION REQUESTING THE TAX FORFEIT PROPERTY KNOWN AS OUTLOT A RIVERSIDE WEST BE RETAINED AS PUBLIC PROPERTY FOR THE USE AS DRAINAGE AND UTILITY EASEMENT. WHEREAS, on September 11, 1998 deed number 189294 was issued to the City of Ramsey for Outlot A, Riverside west subdivision as tax forfeit property for use in the straightening and widening of 137th Avenue NW, and; WHEREAS, in the subsequent five years after obtaining this parcel the City has not straightened or widened 177th Avenue NW, and; WHEREAS, tax forfeit property which is not in use after five years for its stated pm-pose must revert back to the state, and; WHEREAS, said Outlot A would serve public purpose as a drainage and utility easement in the event that repair or replacement of the Dolomite Street sewage lift station is necessary, and WHEREAS, the attached application for Approval of a NeTM Use of Tax Forfeited Land makes possible an adjustment of the public use for which the tax forfeited property was obtained. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the City Engineer is hereby authorized and directed to submit an Application for Approval ora New Use of tax Forfeited Lands for Outlot A Riverside West subdivision for the new use of drainage and utility easement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Elvig Councilmember Zimmerman Councilmember Cook Councilmember Kurak Councilmember Pearson Councilmember Strommen and the following voted against the same: RESOLUTION 04-03-070 lof 2
