Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #15-08-209 <br />A RESOLUTION AFFIRMING STAFF'S INTERPRETATION OF LAWFUL NON- <br />CONFORMING SURFACE AREA FOR THE PROPERTIES LEGALLY DESCRIBED AS <br />OUTLOT B AND LOT 1 BLOCK 1 VERNDALE COMMERCIAL PARK. <br />WHEREAS, the Property Owner has contended that the site has been used continuously <br />as a car dealership for many years; and <br />WHEREAS, the site has also had instances with code enforcement in the past with <br />questions over the exact location of the surface area and aerial photos from previous years have <br />shown a distinct area that has been maintained with class v material for the sellable area; and <br />WHEREAS, on August 10, 2015, the Property Owner, Tenant, and City Staff reached an <br />agreeable solution to maintain required setbacks from the property border and public road right- <br />of-way (greenspace) along with a clear distinction to the sellable area from the vegetation, and to <br />classify the area as lawful non -conforming. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That the Ramsey City Council hereby approves the area in the attached exhibit as lawful non- <br />conforming regarding surface material for the properties legally described as Outlot B and Lot 1, <br />Block 1 Verndale Commercial Park. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />the 25th day of August, 2015. <br />Mayor <br />
