CC Regular Session <br />Meeting Date: 08/25/2015 <br />By: Tim Gladhill, Community Development <br />7. 1. <br />Information <br />Title: <br />Adopt Ordinance #15-10 Vacating Permanent Road Easement for Ridgepoint <br />Purpose/Background: <br />The purpose of this case is to consider adopting Ordinance #15-10, formally vacating an existing road easement in <br />the project area known as Ridgepoint. The request is part of the Application from Village Bank. The City Council <br />has previously approved the Plat, Assessment Agreement, and Improvement Project for this development. To <br />ensure that the easement was not prematurely vacated, as it is currently necessary for the Mississippi River Trail, <br />Staff postponed final adoption until all other actions were approved. <br />Notification: <br />Staff attempted to notify all Property Owners within 700 feet of the Subject Property via Standard US Mail of the <br />Public Hearing held by the Planning Commission. A Public Hearing Notification was also published in the Anoka <br />County UnionHerald. <br />Observations/Alternatives: <br />Alternatives <br />Alternative #1: Adopt Ordinance #15-10. The Plat has been approved and necessary easements are adequately <br />replaced on said plat. This action is needed to formally record the plat. <br />Alternative #2: Do not adopt Ordinance #15-10. By not vacating the easement, the amount of buildable area is <br />restricted. The easement is no longer needed once the plat is recorded, which will provide the necessary <br />encumbrance for the Mississippi River Trail and right of way for Rivlyn Avenue. Staff does not recommend this <br />alternative. <br />Funding Source: <br />All costs associated with processing the Application are the responsibility of the Applicant. <br />Recommendation: <br />As the ordinance has already been introduced, Staff recommends that the City Council adopt Ordinance #15-10. <br />Action: <br />Motion to waive the City Charter requirement to read the ordinance aloud, and adopt Ordinance #15-10 Vacating <br />Permanent Road Easement. <br />Roll Call Vote: <br />Councilmember Riley <br />Councilmember Shryock <br />Councilmember Williams <br />Councilmember LeTourneau <br />Councilmember Kuzma <br />Councilmember Johns <br />
