The statement "There is a significant probability that these soils do <br />not preclude seepage down into the bedrock aquifer" is the Hearing Examiner's <br />own speculation and not supported by the record. In fact, the geologist!s <br />report concludes the opposite. (See Exhibits 00, QQQ and discussion of Soil <br />and Aquifer Conditions in this report:) <br /> <br />~54. No suggestion for a liner or'monitoring system for a processing facility <br />was discussed in the record. The Examiner failed to note that a landfi)l <br />and a processing facility~hich is an above-ground indust.rial operation) are <br />radically different operations and precautions for one would not necess,rily <br />be applicable tO the other. <br /> <br />~55. The Examiner's speculation on unmapped wetlands and their characteristics <br /> is not substantiated nor even mentioned in the record. The examiner at various <br /> times"refers to wetlands in the area as a "lake-wetland complex"' (Finding <br /> ~55 ),"lakes and ponds" (~SB), "important lake-wetland complex" (p.-15) <br /> although nothing in the record discusses lakes, ponds nor-the significance <br /> of we:lands in the area. The Examiner fails to'note that all. wetlands designated <br /> as public waters have been removed from the area. <br /> <br />~58 and 5g. The ONR identified 7 wetlands but no lakes or ponds within the <br /> ace~. The wetlands were removed from the area prior to the hearing and this <br /> fact was discussed at the hearing. (T. p. 16, gO-gl, eve.) Since there <br /> are no identified public lakes or ponds in the area, the 1000' shoreland <br /> is not applicable. (Exhibit dU.) " <br /> <br />m <br />m <br /> <br />~65. The entire area is zoned and planned for indUstrial development. Nothing <br /> in the record-discussed any current agricultural uses of the area, nor will' <br /> the designation or deletion of the area change its existing and planned industrial <br /> usage. <br /> <br /> Staff Recommendations .. <br /> <br />If :he Board chooses to include the Ramsey area in the inventorY'of preferred <br />-a~e'as, the staff recon~nends deletion of the area north of Industry Ave. and <br />west of the eastern edge of the Gatewa~ North Industrial Airport. This reduction: <br /> <br /> 1) Provides additionai assurance of buffer to residence~ located north <br /> of the area; <br /> <br /> 2)' Excludes the airport ptopert~ and most, if not all, of any major ~estrtcted <br /> zones associated with the ends of the runways; <br /> <br />m 3) Includes'the area.nearest to the existing sewer line (located at the <br /> border of Ramsey), " <br /> <br />m .4). Includes'area'within one'mile of receiving's~ream; <br /> 5) Excludes. Area.P-~etng.considered as a ·candidate landfil~ site.. <br /> <br /> <br />
