I <br /> <br />I <br />i <br /> <br />I <br /> <br />-7- <br /> <br />the intent of the Council not to waive the requirements of this <br />section with respect to land. <br /> <br />g$ <br /> <br />The estimated market value of each parcel as determined by the City <br />Assessor following such division of land and property must exceed <br />the amount of special assessments previously levied and allocated <br />to each parcel, including the amount of assessments estimated to be <br />levied again in accordance with this section by reason of such <br />division of land and property. <br /> <br />170.039E <br /> <br />CITY PARTICIPATION, NON-RESIDENTIAL DEVELOPHENTS <br /> <br />Certain Improvements. The owner or subdivider, engaged in the <br />development of lands and properties which are zoned for Non- <br />Residential Districts, may request City participation in the payment of <br />the costs of the installation of sanitary sewer, water system, storm <br />sewer, streets and curb and ~utter improvements required by this <br />section and, in such event, such o~ner or'subdivider shall comply with <br />the requirements of this section. <br /> <br />Assessments. The procedure for the installation and assessment of the <br />cost of improvements under this section shall be the same as that /~,/~ <br />provided for improvements in land in areas zoned for Residence ~O~/t~t~ <br />classifications pursuant to section 170.039D except that: <br /> <br />Special assessments for the cost of sanitary sewer, storm water and <br />water system improvements shall be.for a period of ten (10) years; <br />and <br /> <br />The bond or letter of credit guaranteeing payment of the special <br />assessments for sanitary sewer, storm water and water system <br />improvements shall obligate the o~ner or subdivider for the length <br />of the assessment. <br /> <br />170.039F <br /> <br />SUBDIVIDER HAY PERFORH WORK, ELECTION <br /> <br />The o~ner or subdivider may elect to construct the improvements required by this <br />section at his o~n expense and without City participation in the expense <br />thereof. In such event, the o~ner or subdivider may retain an engineer and <br />contractor to plan, design and install such services, subject to review and <br />inspection by the City Engineer. The estimated cost of the improvements, <br />including the administrative charges of the City Engineer for supervision and <br />inspection, shall be included in the o~'ner or subdivider's contract with the <br />City pursuant to Section 170.039G, and the appropriate security in the form of <br />cash, letter of credit or bond shall be deposited with the City as required by <br />that section. On projects ~hich provide benefit to other areas in addition to <br />the subdivider's property, the project shall be constructed as a City project. <br /> <br />170.039G PERFORHANCE CONTRACT <br /> <br />Prior to the installation of any required improvements by a subdivider and prior <br />to Council approval of the final plat, the subdivider shall enter into a <br /> <br /> <br />
