I I i I -7- the intent of the Council not to waive the requirements of this section with respect to land. g$ The estimated market value of each parcel as determined by the City Assessor following such division of land and property must exceed the amount of special assessments previously levied and allocated to each parcel, including the amount of assessments estimated to be levied again in accordance with this section by reason of such division of land and property. 170.039E CITY PARTICIPATION, NON-RESIDENTIAL DEVELOPHENTS Certain Improvements. The owner or subdivider, engaged in the development of lands and properties which are zoned for Non- Residential Districts, may request City participation in the payment of the costs of the installation of sanitary sewer, water system, storm sewer, streets and curb and ~utter improvements required by this section and, in such event, such o~ner or'subdivider shall comply with the requirements of this section. Assessments. The procedure for the installation and assessment of the cost of improvements under this section shall be the same as that /~,/~ provided for improvements in land in areas zoned for Residence ~O~/t~t~ classifications pursuant to section 170.039D except that: Special assessments for the cost of sanitary sewer, storm water and water system improvements shall be.for a period of ten (10) years; and The bond or letter of credit guaranteeing payment of the special assessments for sanitary sewer, storm water and water system improvements shall obligate the o~ner or subdivider for the length of the assessment. 170.039F SUBDIVIDER HAY PERFORH WORK, ELECTION The o~ner or subdivider may elect to construct the improvements required by this section at his o~n expense and without City participation in the expense thereof. In such event, the o~ner or subdivider may retain an engineer and contractor to plan, design and install such services, subject to review and inspection by the City Engineer. The estimated cost of the improvements, including the administrative charges of the City Engineer for supervision and inspection, shall be included in the o~'ner or subdivider's contract with the City pursuant to Section 170.039G, and the appropriate security in the form of cash, letter of credit or bond shall be deposited with the City as required by that section. On projects ~hich provide benefit to other areas in addition to the subdivider's property, the project shall be constructed as a City project. 170.039G PERFORHANCE CONTRACT Prior to the installation of any required improvements by a subdivider and prior to Council approval of the final plat, the subdivider shall enter into a
