The division and consolidation of lots which are part of <br />a recorded plat and tracts which are part of a recorded Registered Land <br />Survey is subject to the provisions of this subsection. <br /> <br />e <br /> <br />Building Permits. No building permit shall be issued for the <br />construction of a structure on lots or tracts divided or consolidated <br />contrary to the provisions of this subsection. <br /> <br />170.0317 <br /> <br />DIVISION OR CONSOLIDATION OF UNPLATTED LOTS <br /> <br />General Rule. The division or consolidation of lots which are not part <br />of a recorded plat and tracts which are not part of a recorded <br />Registered Land Survey are subject to the provisions of this <br />subsection. This subsection shall be applicable to plats with three or <br />less lots that require no construction of streets or utilities other <br />than services to existing laterals. It is the intent of this ordinance <br />to require the division or consolidation of unplatted lots to be <br />platted. <br /> <br />4. Plat Requirements. Required data for platting under this Section shall <br /> be as follows: <br /> <br />a. Identification and description - same as required in Section <br /> 170.037A. <br /> <br />b. Existing conditions - only items 1, 2, 3 and 4 of Section 170.037B <br /> required. <br /> <br />c. Design features - only items 2, 5 and 6 of Section 170.037C. <br /> <br />d. Additional information: <br /> <br />1) Statement of proposed use of lots. <br /> <br />Dedication of street right of way in conformance to City <br />standards if not previously dedicated. <br /> <br />Building Permits. No building permit shall be issued for the <br />construction of a structure on lots or tracts divided or consolidated <br />contrary to the provisions of this subsection. <br /> <br />170.0318 VARIANCES <br /> <br />170.0318A HARDSHIP <br /> <br />The City Council may adopt a resolution to grant a variance from the <br />requirements of this chapter as to specific tracts of land where it is shown <br />that by reason of topography or other physical conditions, strict compliance <br />with these requirements could cause an exceptional and undue hardship to the <br />enjoyment of a substantial property right, provided that a variance may be <br />granted only if the variance does not adversely affect the spirit and intent of <br />this chapter. <br /> <br /> <br />
