The Critical
Areas Act'was passed in 1973 which allowed government to designate areas along
the Mississippi as areas to be protected from development, clear cutting and
stripping of vegetation. This ordinance to be adopted will require a permit
from anyone wishing to develop any of this area. Regulations of this ordinance
would:

I
I
I
I
I

1. Prohibit filling, grading, excavation within wetlands.

2. Assure maximum number of trees be preserved.

3. Specify no development on lands having slopes over 12% unless adequate
slope conditions existed.

4. Require developer to provide site plan of existing topography, existing
drainage, existing soils and ground coverage which occupies the site.

5. Control sedimentation while developing.

6. Allow City Council to determine the permit fee and that permit to
expire 30 days from issuance.

7. Govern all river crossing for utilities or power lines.

Jim Martin - See Attachment I.

The Commission consensus, in regards to Mr. Martins concern regarding Section
170.0112D(c), is that the City wo~ld like to preserve but does not intend to
limit number of houses based on number of clearings.

P&Z/August 2, 1983
Public Hearing
