In case of a conflict, the more <br />restrictive standards will apply. <br />2.3 Incorporation of Maps by Reference: The following maps together with all <br />attached material are hereby adopted by reference and declared to be a part <br />of the Official Zoning Map and this ordinance. The attached material includes <br />the Flood Insurance Study for County, Minnesota, and <br />and the Flood Insurance Rate Map <br />Incorporated Areas, dated <br />panels enumerated below, dated , all prepared by the <br />Federal Emergency Management Agency. These materials are on file in the <br />[list location where maps will be filed — i.e., City Clerk's office). <br />(list all map panels here) <br />2.4 Regulatory Flood Protection Elevation: The regulatory flood protection <br />elevation (RFPE) is an elevation no lower than one foot above the elevation of <br />the regional flood plus any increases in flood elevation caused by <br />encroachments on the floodplain that result from designation of a floodway. <br />2.5 Interpretation: The boundaries of the zoning districts are determined by <br />01141 <br />scaling distances on the Flood Insurance Rate Map. <br />2.51 Where a conflict exists between the floodplain limits illustrated on the <br />official zoning map and actual field conditions, the flood elevations <br />l ' shall be the governing factor. The Zoning Administrator must interpret <br />the boundary location based on the ground elevations that existed on <br />the site on the date of the first National Flood Insurance Program map <br />showing the area within the regulatory floodplain, and other available <br />technical data. <br />2.52 Persons contesting the location of the district boundaries will be given <br />a reasonable opportunity to present their case to the (Planning <br />Commission/Board of Adjustment) and to submit technical evidence. <br />Abrogation and Greater Restrictions: It is not intended by this ordinance to <br />repeal, abrogate, or impair any existing easements, covenants, or other <br />private agreements. However, where this ordinance imposes greater <br />restrictions, the provisions of this ordinance prevail. Counties and <br />townships may need to adopt city map <br />panels to encompass areas that may be <br />detached from cities. See Section 2.10. <br />Optional - Reiterates information in the <br />(mandatory) definition of this term in Section <br />2.9. The RFPE can be increased beyond one <br />foot to provide enhanced flood protection. <br />In A-0 zones, add more detailed language: <br />"Within the AO Zone, the RFPE is an elevation <br />no lower than [the number shown on the <br />FIRM] above the highest adjacent grade of an <br />existing structure or proposed structure or a <br />proposed structural addition." <br />
