<br />Councilmember Shryock introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #15-10-256 <br /> <br />RESOLUTION APPROVING CHANGE ORDER NO. 1 AND SITE RESTORATION <br />AGREEMENT FOR RIDGEPOINT DEVELOPMENT IMPROVEMENTS, <br />IMPROVEMENT PROJECT #15-21 <br /> <br />WHEREAS, <br /> Village Bank and the City of Ramsey executed an Assessment Agreement to <br />allow the City to construct public improvements for a seven (7) unit single-family residential <br />development known as the Ridgepoint development on property owned by Village Bank; and <br /> <br />WHEREAS, <br /> after removing a portion of the east end of Rivlyn Avenue, including the cul- <br />de-sac, and a portion of the newly constructed Mississippi River Trail, a significant quantity of <br />construction and housing debris was discovered on Village Bank’s property during construction <br />of the public improvements; and <br /> <br />WHEREAS, <br /> upon Village Bank’s request the City agrees to enter into Change Order #1 <br />with the Contractor to restore all previously removed public improvements on the east end of <br />Rivlyn Avenue, including the cul-de-sac, and a portion of the newly constructed Mississippi River <br />Trail, to as good or better condition as the pre-development conditions, and to invoice 100% of the <br />costs to Village Bank. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: <br /> <br />1) That said Change Order #1 is hereby approved allowing the City to enter into Change Order <br />#1 with Village Bank for 100% of the costs incurred by the City to reconstruct the <br />Ridgepoint development public improvements, and to grade and otherwise restore the site <br />to allow future maintenance operations to occur routinely. <br /> <br />2) That the Site Restoration Agreement is hereby approved whereby Village Bank shall pay <br />for 100% of the costs incurred by the City to reconstruct the Ridgepoint development <br />public improvements, and to grade and otherwise restore the site to allow future <br />maintenance operations to occur routinely. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />LeTourneau and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Strommen <br /> Councilmember Shryock <br /> Councilmember LeTourneau <br /> Councilmember Johns <br /> Councilmember Kuzma <br /> Councilmember Riley <br /> Councilmember Williams <br />RESOLUTION #15-10-256 <br />Page 1 of 2 <br /> <br /> <br />
