SECTION 4. PROHIBITION During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning and Subdivision of Land", no subdivision or platting of any land within the City shall be permitted and no applications for said subdivision or platting shall be accepted, except for those lands identified in Sections 5 and 6 below. SECTION 5. EXCLUSIONS The fbllowing lands within the City are excluded from this Interim Ordinance: 1. All land currently located within the City's following listed zoning districts: R-1 Residential - MUSA District R-1 Residential - Central Rural Reserve Area R- 1 Residential - Rural Preserve R-2 Medium Density Residential District R-3 High Density Residential District B-1 Business District B-2 Business District E-1 Employment District E-2 Employment District MU-PUD Mixed-Use, Planned Unit Development District PUD Planned Unit Development District TC Town Center District P Public/Quasi Public District SECTION 6. UNDUE HARDSHIP EXCEPTIONS The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, undue hardship may result form strict compliance. In granting'an exception, the City Council shall prescribe any conditions that it deems necessary to or desirable for the protection of the public interest. NO exception shall be granted unless the City Council finds: That there are special circumstances or conditions affecting said property such that the strict application of the provisions of this Interim Ordinance would deprive the petitioner of the reasonable use of petitioner's land. That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated.
