Assistant Public Works Director Olson noted nothing is allowed in the right-of-way, and <br />anything in this area would be able to be removed. <br /> <br />City Attorney Goodrich advised anything on private property could be a taking. That would need <br />to be weighed with safety concerns. <br /> <br />Councilmember Elvig noted the committee discussed that trees will need to be trimmed to a <br />certain height, and this would not necessarily require taking a tree down. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Pearson, to introduce an <br />ordinance establishing the creation of a vision triangle into Chapter 9 of City Code. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Pearson, Kurak, <br />Strommen, and Zimmerman. Voting No: None. Absent: Councilmember Cook. <br /> <br />Case #12: <br /> <br />Consider Amending the Method for Calculating the Rate for Townhomes in <br />the Storm Drainage Utility <br /> <br />Civil Engineer II Linton explained on November 23, 1999, the City Council introduced an <br />ordinance creating a storm drainage utility. The utility was adopted on January 11, 2000. On <br />June 27, 2000, the City Council adopted a resolution establishing the storm drainage utility fees <br />by amending the 2000 schedule of rates, fees and charges. The City Council adopted a resolution <br />modifying the Residential Equivalent Unit (REU). <br /> <br />Civil Engineer II Linton explained the storm water utility has been operational since 2000. The <br />rate for townhouse developments was determined by treating the site like a <br />busincss/retail/industrial site. The gross area was calculated, the impervious area was calculated, <br />the REU factor was determined from these numbers then the total charge was divided by the <br />number of dwelling units in the development. The list generated of the affected addresses did not <br />always get transferred to the billing at Connexus. Recent review of the billing indicates that most <br />townhouse developments have units that are charged the standard single family rate while <br />adjacent units are charged at the rate determined for the development. Council discussed this <br />issue at the February 17, 2004 work session and reached consensus to charge all townhome units <br />a per unit residential charge. Consensus was also reached that if a property owner no longer <br />operated a business on the property then they should only be charged a residential rate. <br /> <br />Mayor Gamec asked if Com~exus will be notified of the change. <br /> <br />Civil Engineer I[ Linton responded in the affirmative. <br /> <br />Mayor Gamcc asked when the ordinance would take effect. <br /> <br />Civil Engineer II Linton replied the ordinance would come back for adoption on April 27th and <br />would take effect on May 30th. <br /> <br />City Council/April 13, 2004 <br /> Page 29 of 33 <br /> <br /> <br />
