1. STRUCTURE. All building plans must be prepared and certified by a registered <br />engineer or architect. <br />2. STATE BUILDING CODE COMPLIANCE. The structure shall be constructed in <br />accordance with the requirements of the State Building Code. <br />3. SITE PLAN COMPLIANCE. The Structure shall be constructed on the Site as shown <br />on the approved Site Plan prepared by EM Branstrom Associtates. (the "Site Plan"). <br />4. REQUIRED IMPROVEMENTS. The Permittee shall construct and install the <br />following site improvements on the Site in accordance with the specifications and <br />location as shown on the Site Plan. The Required Improvements are as follows: <br />a. Site grading in accordance with the Grading Plan prepared by Hakanson Anderson <br />and in accordance with City Staff review letter dated April 29, 2005. <br />b. Installation of concrete and bituminous driveways and parking lot. <br />c. Installation of B-6/12 continuous concrete curbing around the perimeter of all <br />concrete and/or bituminous surfaces. <br />d. Establishment of and sode in accordance with the Site Plan. <br />e. Installation of landscaping materials in accordance with the Site Plan and in <br />accordance with the City staff review letter dated April 29, 2005. <br />(the "Required Improvements)". <br />5. FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of the fire <br />lanes on the Site shall be as directed by the City's Fire Chief. <br />6. LIGHTING. The site plan indicates there will be no outside lighting on the Site. <br />7. BUILDING FACADE. The Permittee agrees to construct all building faces of the same <br />material as listed on the Building Elevations Plan prepared by EM Branstrom Associates. <br />S. STORMWATER MANAGEMENT FEE. The Stormwater Management Fee shall be <br />due at the closing of the sale of the Development Property to the Permittee. <br />9. REQUIREMENTS FOR BUILDING PERMIT. No building permit for the Site will be <br />issued until the Permittee has: a) signed and returned this Development Permit; and b) <br />provided the City with a copy of the LRRWMO permits. c) the City is in receipt of the <br />Inspection Fee. <br />No Certificate of Occupancy for the Structure will be issued until the Required <br />Improvements, or a financial surety for same, are accepted by the City. <br />10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be constructed and completed before June 1, 2006. <br />31 <br />
