Review letter of the pending issue. The Planning Commission held a public hearing and <br />reviewed the preliminary plat at their March 11, 2004 meeting and recommended approval of <br />Rivcnwick 4th Addition contingent on the City Staff Review Letter dated March 5, 2004, revised <br />April 9, 2004, and included language in the Development Agreement stating that the remaining <br />property zoned MU-PUD will include commercial development and will not be maximized with <br />residential uses. <br /> <br />Councilmember Zimmennan asked if the developer is willing to build some of the sound walls to <br />cut down on the noise on Highway 10. <br /> <br />David Schulte of Turtle Moon Inc. replied they are willing to consider it. They have gone a long <br />ways to mitigate the noise. They are moving the building back and have tried to do extensive <br />tree planting. A 15 foot wall would be a deal killer, because no one would want to live on one <br />side of that. <br /> <br />Councilmember Zimmerman explained the Council had discussed that they do not want a long <br />wall for ¼ mile, and the wall could be broken up. He questioned if there was any thought of <br />constructing the buildings that abut Highway 10 with better sound proofing. <br /> <br />A representative of Ryland Homes replied STC 30 windows will be installed, and there will be <br />additional insulation in the walls to address noise mitigation within the interior of the units. <br /> <br />Councilmcmber Kurak stated due to the high density she would like to see a sidewalk on both <br />sides of City streets. She would like the City to go towards that with all developments on City <br />streets. <br /> <br />Ms'. Schulte replied he does not see a problem with that. <br /> <br />Councihnember Kurak inquired if there could be a connection from the condominium units to <br />the trail. <br /> <br />Associate Planner Wald noted the Park Commission has requested this as well. <br /> <br />Ms'. Schulte indicated this should not be a problem. <br /> <br />Councilmember Kurak inquired if the end problematic unit concerning the 25 foot street setback <br />could be moved westerly. <br /> <br />Mr. Schulte replied he thought this had been addressed, and this can be worked out. <br /> <br />Councilmember Kurak questioned how the balance of commercial to residential property will be <br />stated is] the residential agreement. <br /> <br />Associate Planner Wald replied any development agreement will go along with any successors of <br />Mt'.
