Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #04-03-078 A RESOLUTION ADOPTING FINDING OF FACT #0667 RELATING TO A REQUEST FROM JAMES COROLEWSKI FOR A HOME OCCUPATION PERMIT TO ESTABLISH AN IN-HOME GUNSMITHING FACILITY ON THE PROPERTY LOCATED AT 15511 BASALT STREET N.W. WHEREAS, the City of Ramsey received an application from James Corolewski for a home occupation permit to operate a gunsmithing shop within the dwelling on the property generally known as 15511 Basalt Street NW and legally described as follows: Lot 7, Block 2, High Point Addition, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on February 9, 2004, James Corolewski, hereinafter referred to as "Applicant", properly applied for a home occupation permit to establish and operate a gunsmithing shop in his home. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.05 of the City Code on March 11, 2004, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Subject Property is zoned R-1 Single Family Residential. 4. That the Subject Property is approximately 1.9 acres in size. That a Home Occupation Permit is required in order to conduct in-home commercial activities in the R-1 Single Family Residential District. That the Applicant has stated that the gunsmithing activities will consist of repair, cleaning, modification, restoration and customizing existing firearms; there is no manufacture of firearms associated with the proposed business. That the Applicant has provided documentation to support that the home occupation will be conducted within the private dwelling on the property, that the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling, and the operation will not include any employment of persons not residing in the private dwelling in the performance of the home occupation. o That the floor plan submitted indicates that there will be a secured entry area for receiving customers that will be separated from the room in which guns are stored and where gunsmithing activities will take place.
