Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-05- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FROM P.A.C.T. CHARTER SCHOOL TO ALLOW FOR TEMPORARY <br />CLASSROOM STRUCTURES ON THE SITE OF THE P.A.C.T. CHARTER SCHOOL <br />FOR AN INTERIM PERIOD OF TIME. <br /> <br /> WHEREAS, P.A.C.T. Charter School, hereinafter referred to as "Applicant", have <br />properly applied to the City of Ramsey (the "City") for an Interim Use Permit to place temporary <br />classroom structures on the site of their future school for an interim period of time on the <br />property generally known as 7250 East Ramsey Parkway and legally described as follows: <br /> <br />Lot 1, Block 1, Ramsey Town Center Addition <br />(the "S ubject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on May 6, 2004 and that the public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />2) <br /> <br />That the Subject Property is approximately 5.5 acres in size and is Zoned TC-3a Town <br />Center; the surrounding parcels are zoned TC-3 Town Center and TC-4c Town Center. <br /> <br />3) <br /> <br />That Section 9.03.06(1) (Interim Use Permits) of the Ramsey City Code allows for <br />interim uses to allow a use for a limited period of time that reasonably utilizes the <br />property where it is not reasonable to utilize it in the manner provided by the <br />comprehensive guide and to allow a use that is presently acceptable but that, with <br />anticipated development will not be acceptable in)he future. <br /> <br />4) <br /> <br />That on April 5, 2004, the Applicants submitted a request for an Interim Use Permit to to <br />place temporary classroom structures on the site of their future school. <br /> <br />That the Applicants have stated their building will be ready for full occupancy on October <br />15, 2004. <br /> <br />6) <br /> <br />That the proposed temporary classrooms shall conform to the State Fire and Building <br />Codes. <br /> <br />7) <br /> <br />That the proposed use will/will not impose additional costs on the public if it is necessary <br />fbr the public to take the property by eminent domain in the foreseeable future. <br /> <br />8) <br /> <br />That the proposed interim use will/will not result in adverse effects on the public health, <br />safety and welfare of the residents of the City. <br /> <br />9) That d~e proposed use will/will not adversely impact traffic in the area. <br /> <br />31 <br /> <br /> <br />
