Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #04-05- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FROM P.A.C.T. CHARTER SCHOOL TO ALLOW FOR TEMPORARY CLASSROOM STRUCTURES ON THE SITE OF THE P.A.C.T. CHARTER SCHOOL FOR AN INTERIM PERIOD OF TIME. WHEREAS, P.A.C.T. Charter School, hereinafter referred to as "Applicant", have properly applied to the City of Ramsey (the "City") for an Interim Use Permit to place temporary classroom structures on the site of their future school for an interim period of time on the property generally known as 7250 East Ramsey Parkway and legally described as follows: Lot 1, Block 1, Ramsey Town Center Addition (the "S ubject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on May 6, 2004 and that the public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2) That the Subject Property is approximately 5.5 acres in size and is Zoned TC-3a Town Center; the surrounding parcels are zoned TC-3 Town Center and TC-4c Town Center. 3) That Section 9.03.06(1) (Interim Use Permits) of the Ramsey City Code allows for interim uses to allow a use for a limited period of time that reasonably utilizes the property where it is not reasonable to utilize it in the manner provided by the comprehensive guide and to allow a use that is presently acceptable but that, with anticipated development will not be acceptable in)he future. 4) That on April 5, 2004, the Applicants submitted a request for an Interim Use Permit to to place temporary classroom structures on the site of their future school. That the Applicants have stated their building will be ready for full occupancy on October 15, 2004. 6) That the proposed temporary classrooms shall conform to the State Fire and Building Codes. 7) That the proposed use will/will not impose additional costs on the public if it is necessary fbr the public to take the property by eminent domain in the foreseeable future. 8) That the proposed interim use will/will not result in adverse effects on the public health, safety and welfare of the residents of the City. 9) That d~e proposed use will/will not adversely impact traffic in the area. 31
