Mr. Fitzpatrick is also asking that the City waive the application fees for the Comprehensive Plan
Amendment and Zoning Amendment.

Recommendation:

While it may not be clear what the exact reason was for changing the subject property's land use
in the Comprehensive Plan, the property has been historically residential and is located directly
on the river. In recent Comprehensive Plan amendment requests, the City Council has indicated a
preference for non-commercial uses directly on the river, with the possibility of changing to a
commercial use if a desirable plan is brought forward by the land owner. The redevelopment of
this parcel for a commercial use may also be constrained by its location directly on the river and
potential need for expanded access to Highway 10.

Commission Action:

Motion to recommend that the City Council adopt a resolution approving the change from Low-
Density Residential to Places to Shop for the property located at 7150 Highway 10..

-or-

Motion to recommend that the City Council deny the request for a Comprehensive Plan
Amendment.

Reviewed by:
Community Development Director
Associate Planners

Copies to:
City Attorney

PC: 5/6/04

38
