PUBLIC HEARING <br /> REQUEST TO REZONE CERTAIN PROPERTY <br /> FROM R-1 RESIDENTIAL TO B-2 BUSINESS; <br /> CASE OF PATRICK FITZPATRICK. <br />By: Patrick Trudgeon, AICP, Assistant Community Development Director <br /> <br />CASE <br /> <br />Background: <br /> <br />Patrick Fitzpatrick has requested that the City rezone his property at 9150 Highway 10 from R-1 <br />Residential to B-2 Highway Business. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Proposed Findings of Fact <br /> <br />Notification: <br /> <br />State statute requires that property owners within 350 feet of the subject property be notified of the public <br />hearing. <br /> <br />Observations: <br /> <br />As discussed in the previous Comprehensive Plan Amendment case, the subject property's zoning was <br />changed to residential to comply with the 2001 Comprehensive Plan. If the Comprehensive Plan <br />Amendment is approved by the City Council, the property will need to be rezoned to B-2 Business. <br /> <br />Recommendation: <br /> <br />Based on discussion. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt Findings of Fact relating to a request from Patrick <br />Fitzpatrick to rezone the subject property from R-1 Residential to B-2 Business. <br /> <br />-and- <br /> <br />Motion to recommend that City Council approve the request to rezone the subject property, based on the <br />Findings of' Fact. <br /> <br />Motion to recommend that the City Council deny the request for rez°ning. <br />Reviewed by: Copies to: <br />Community Development Director City Attorney <br />PC: I}4/06/04 <br /> <br />43 <br /> <br /> <br />
