Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04- - <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br />PROPERTY FROM R-1 LOW DENSITY RESIDENTIAL TO B-2 HIGHWAY <br />BUSINESS <br /> <br /> WHEREAS, on March 29, 2004, the City received an application to rezone certain <br />propet~ty in accordance with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That Patrick Fitzpatrick, hereinafter referred to as "Appl!cant," has properly applied to rezone <br /> certain property from R-1 Low 'Density Residential to B-2 Highway Business. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of the <br />City Code on May 6, 2004 and said public hearing was properly advertised, and the minutes <br />of said public hearing are hereby incorporated bY reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />Lot 9, Aud Sub No. 033, Anoka County, Minnesota <br /> <br />4. That the area of the property to be rezoned is approximately 5.5 acres in size. <br /> <br />5. Prior to adoption of the 2001 Comprehensive Plan and subsequent re-zoning, the Subject <br /> Property was zoned Highway Business. <br /> <br />6. That the Subject Property has been historicallya residential use. <br /> <br />7. That the Subject Property is currently zoned R-1 Low Density Residential and is located <br /> within the boundaries of the current Metropolitan Urban Service Area (MUSA). <br /> <br />8. That the Comprehensive Plan designates the property for Low Density Residential <br /> development. <br /> <br />9. That the Applicant has submitted a Comprehensive Plan Amendment to change the land use <br /> designation in the Comprehensive Plan from Low Density Residential to Places to Shop. <br /> <br />10. That the proposed zoning amendment will/will not substantially adversely impair the use or <br /> market value of any surrounding property. <br /> <br />11. That the proposed zoning amendment will/will not change the essential character of the area, <br /> which is residential. <br /> <br />45 <br /> <br /> <br />
