Councihnember Kurak questioned if there is room to put a City street in this area. <br /> <br />Assistant Public Works Director Olson replied the street would not have the acceptable setbacks <br />that a normal subdivision would need. Taking the street over as a City street would definitely <br />create a loophole in that no one would come in for subdivision, but would say they want a private <br />street. After the building was done they would likely say they now want the street to be public. <br /> <br />Councihnember Cook indicated the Committee discussed that at this point the City has no <br />intention of taking the street over as a public street, but they would help the association get <br />information on improvements for their road so they can get up to public standards on their own. <br /> <br />Assistant Public Works Director Olson explained his intention is to write a letter outlining the <br />Cotmcil's discussion, saying they would need a letter from the association stating they would be <br />willing to pay the $400, as well as allowing the City to enter on their private property to do the <br />work. He will make it clear that the City currently has no intention of taking the street over. The <br />association may decide at a later date to take this back to the Council. <br /> <br />Councihnember Elvig indicated he thinks this group is aware that the City is not interested in <br />taking over private streets, which would set a bad precedent. They previously thought they may <br />be an exception, but now they know they are not. The association wants to know what they need <br />to do to get to the public street status. Doing a soil boring would help the association, and <br />would help the City as well as to know if this is even feasible. The boring will be at the <br />association's cost. <br /> <br />Councihnember Zimmerman reported the recommendation of the Committee was to spend the <br />$400 and be reimbursed by the association. <br /> <br />Motion by Councihnember Zimmerman, seconded by Councilmember Cook, to ratify the <br />recommendations of the Personnel Committee for Case 2, recommend that staff continue <br />working with the Met Council on the issue of a new station, Case 4, adopt the Policy Regarding <br />Placement of the Wear Course Bituminous Lift, and Case 6, hire Northern Technologies at a not <br />to exceed cost of $400 contingent upon the Rum River Hills Townhouse Association issuing a <br />letter agreeing to the reimbursement and allowing the soil boring to be done on their private <br />property. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Cook, Elvig, Kurak, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #6: <br /> <br />Introduce Amendment to City Code Section 4.40.06 Subdivision 10 Relating <br />to Water Use Restrictions <br /> <br />Assistant Public Works Director Olson explained this amendment to the City Code relates to <br />water use restrictions and staff recommends approval. <br /> <br />City Council/May 11, 2004 <br />Page 14 of 36 <br /> <br /> <br />
